MISCELLANEOUS ENTRIES RELATED TO DUII CONVICTIONS<br />

The following entries are related <strong>to</strong> convictions for <strong>Driving</strong> Under the Influence <strong>of</strong> In<strong>to</strong>xicants (DUII).<br />

DIVERSION AGREEMENT<br />

The following entry is made on the driving record when a driver enters the program and a<br />

“diversion agreement” is sent by the court <strong>to</strong> DMV.<br />

Diversion.<br />

Beginning date <strong>of</strong> the diversion agreement.<br />

Court type and location that granted the diversion. If the court name is more than five letters<br />

in length, it is abbreviated. Court types that display are: C = Circuit; D = District; M =<br />

Municipal; and J = Justice.<br />

Court’s docket number for the diversion.<br />

Disposition code. This field is blank if no disposition or V if vacated.<br />

Ending date <strong>of</strong> the diversion agreement.<br />

Indicates OFFENS DT for Offense Date or ARREST DT for Arrest date.<br />

IGNITION INTERLOCK DEVICE<br />

A person is required <strong>to</strong> have an Ignition interlock devices (IID) on any vehicle they operate. The<br />

length <strong>of</strong> the requirement for an IID depends on the driver record:<br />

One year for a first DUII conviction; two years for a second or subsequent DUII conviction; or<br />

five years for an aggravated vehicular homicide conviction;<br />

Five years if the DUII conviction included, as part <strong>of</strong> the same criminal episode, a conviction<br />

for: murder; manslaughter in the first or second degree; criminally negligent homicide; or<br />

assault in the first degree;<br />

Five years if the DUII conviction included permanent revocation <strong>of</strong> driving privileges by a<br />

court under ORS 809.235(1)(b) and later ordered res<strong>to</strong>red under ORS 809.235(4);<br />

For the length ordered by an <strong>Oregon</strong> court as a condition <strong>of</strong> a DUII diversion agreement.<br />

The IID requirement starts from the date ordered by the court for a DUII diversion agreement; the<br />

end dates <strong>of</strong> the suspension or revocations caused by the conviction; and during a DUII<br />

suspension if the driver applies for a hardship permit. The following is an example <strong>of</strong> how IID<br />

entries appear on a driving record:<br />

related DUII suspension. Older segments will show a 6 months ending date.<br />

Displays the IID requirement.<br />

The following entry will display on the driving record <strong>to</strong> indicate the driver installed an IID:<br />
