Aesthetics<br />

Impact AES-1, see <strong>Mitigation</strong> Measures MM CR-2 <strong>and</strong> MM<br />

CR-3, below, under Cultural Resources.<br />

Air Quality<br />

MM AQ-1. Fleet Modernization for Off-Road Equipment. Timing: Prior to <strong>and</strong> during construction.<br />

1. Construction equipment shall incorporate, where<br />

feasible, emissions savings technology such as hybrid drives<br />

<strong>and</strong> specific fuel economy st<strong>and</strong>ards.<br />

2. Idling shall be restricted to a maximum of 5 minutes<br />

when not in use.<br />

3. Tier Specifications:<br />

a. From January 1, 2012, to December 31, 2014: All offroad<br />

diesel-powered construction equipment greater than 50<br />

hp, except marine vessels <strong>and</strong> harbor craft, will meet Tier-3<br />

off-road emission st<strong>and</strong>ards at a minimum. In addition, all<br />

construction equipment greater than 50 hp will be retrofitted<br />

with a CARB-verified Level 3 DECS. Per Port’s<br />

Construction Guidelines, for CEQA Project, in 2012 to 2014,<br />

construction equipment shall meet 50% Tier 3 Level 3, 20%<br />

Tier 2 Level 3, 10% Tier 1 Level 3, 10% Tier 2 Level 2, <strong>and</strong><br />

10% Tier 1 Level 2.<br />

b. Post-January 1, 2015 on: All off-road diesel-powered<br />

construction equipment greater than 50 hp, except marine<br />

vessels <strong>and</strong> harbor craft, will meet Tier-4 off-road emission<br />

st<strong>and</strong>ards at a minimum. Per Port’s Construction Guidelines,<br />

for CEQA Project, in 2015 <strong>and</strong> going forward, construction<br />

equipment shall meet 50% Tier 4, Tier 3 Level 3, 20% Tier 3<br />

Level 3, 10% Tier 1 Level 3, 10% Tier 2 Level 2, <strong>and</strong> 10%<br />

Tier 1 Level 2.<br />

Methods: This measure shall be incorporated into<br />

BNSF’s <strong>and</strong> Alternate Business Location Tenants’ bid<br />

<strong>and</strong> contract specifications approved by LAHD for all<br />

construction work to reduce the impacts of construction<br />

diesel emissions. The contractor(s) shall submit an<br />

Environmental Compliance Plan for review <strong>and</strong><br />

approval by BNSF <strong>and</strong> Tenants prior to beginning any<br />

construction activity. The contractor(s) shall adhere to<br />

these specifications throughout construction phases.<br />

Enforcement shall include oversight by BNSF’s <strong>and</strong><br />

Tenants’ project/construction managers or designated<br />

building inspectors to ensure compliance with contract<br />

specifications.<br />

The construction equipment measures shall be met,<br />

unless one of the following circumstances exist <strong>and</strong> the<br />

contractor is able to provide proof that any of these<br />

circumstances exists:<br />

• A piece of specialized equipment is unavailable in a<br />

controlled form within the state of California,<br />

including through a leasing agreement.<br />

• A contractor has applied for necessary incentive<br />

funds to put controls on a piece of uncontrolled<br />

equipment planned for use on the project, but the<br />

application process is not yet approved, or the<br />

application has been approved, but funds are not yet<br />

available.<br />
