Provided that the court shall not so release the thing to the claimant<br />

unless it is satisfied that the claimant is the owner thereof or, by reason of an<br />

interest therein, is entitled to the possession thereof, and if the court is not so<br />

satisfied, the thing shall be condemned as if no claim thereto had been made.<br />

53. (1) Where anything has been seized under this <strong>Act</strong> as being liable to<br />

forfeiture, then the condemnation of the thing shall be in no way affected by the<br />

fact that an owner of the thing was in no way concerned with the act which<br />

rendered it liable to forfeiture.<br />

(2) Where anything is condemned under this <strong>Act</strong> then –<br />

(a) subject to section 55, the thing shall be forfeited and may be sold,<br />

destroyed or otherwise disposed of as the Commissioner may think fit;<br />

(b) condemnation of a thing shall have effect as from the date when the<br />

liability to forfeiture arose;<br />

(c) condemnation shall subject to any appeal against proceedings which<br />

resulted in the condemnation, be final, save as provided in section 54, no<br />

application or proceedings for restoration shall lie.<br />

(3) Where goods have been condemned and are in the possession of<br />

some authority other than the Commissioner they shall be returned to the<br />

Commissioner for disposal under subsection (2).<br />

(4) Where goods are sold by public auction thirty days’ notice of sale<br />

shall be given in such manner as the Commissioner may direct.<br />

(5) Where goods are sold under this section the proceeds thereof shall<br />

be applied in the discharge of -<br />

(a) the value added tax, if any;<br />

(b) the expenses of removal and sale;<br />

(c) the rent and charges due to the Commissioner; and<br />

(d) the freight and any other charges.<br />

(6) The balance, if any, left after application of the proceeds under<br />

subsection (5) shall be paid into the Value Added Tax revenue.<br />

54. Where anything has been seized under this <strong>Act</strong>, then the Minister may,<br />

whether or not the thing has been condemned, direct that it shall be released and<br />

restored to the person from whom it was seized or to the owner thereof, upon<br />

such conditions as the Minister may think fit.<br />
