If you live <strong>in</strong> <strong>Belgium</strong> <strong>and</strong> w<strong>or</strong>k <strong>in</strong> paid employment <strong>in</strong> the<br />
Netherl<strong>and</strong>s, <strong>and</strong> you fall ill, you must comply with the Dutch<br />
rules f<strong>or</strong> rep<strong>or</strong>t<strong>in</strong>g sick. Your employer will then cont<strong>in</strong>ue to<br />
pay your wages f<strong>or</strong> up to two years <strong>and</strong> cannot dismiss you<br />
dur<strong>in</strong>g this period. If you are no longer able to w<strong>or</strong>k, you can<br />
get a Dutch <strong><strong>in</strong>capacity</strong> benefit.<br />
What to do if you need<br />
to rep<strong>or</strong>t sick<br />
You must rep<strong>or</strong>t sick to your employer <strong>and</strong> to your Belgian health <strong>in</strong>surance<br />
fund (mutualiteit) with<strong>in</strong> two w<strong>or</strong>k<strong>in</strong>g days. Your employer may require you to<br />
rep<strong>or</strong>t sick bef<strong>or</strong>e a certa<strong>in</strong> time on the first day of illness.<br />
Your employer may ask the mutualiteit <strong>or</strong> a doct<strong>or</strong> of the employer’s choice to<br />
carry out an exam<strong>in</strong>ation, the results of which will be f<strong>or</strong>warded to the Dutch<br />
Institute f<strong>or</strong> Employee Benefit Schemes (UWV) <strong>or</strong> the occupational health<br />
doct<strong>or</strong>. You can also go to the occupational health doct<strong>or</strong> <strong>or</strong> UWV f<strong>or</strong> a<br />
medical exam<strong>in</strong>ation at your own request.<br />
How much will you get<br />
if you fall ill?<br />

If you are <strong>in</strong> paid employment, your employer will cont<strong>in</strong>ue to pay at least<br />
70% of your wages. On the basis of collective agreements, many employees<br />
will receive 100% of their wages <strong>in</strong> the first year of illness. Your wages will<br />
cont<strong>in</strong>ue to be paid f<strong>or</strong> up to two years (104 weeks) if you fall ill.<br />

If you are a temp<strong>or</strong>ary w<strong>or</strong>ker, <strong>or</strong> if your employment contract ends while<br />
you are ill, <strong>in</strong>stead of your wages, you will receive a sickness benefit from<br />
the Institute f<strong>or</strong> Employee Benefit Schemes (UWV). The benefit will be paid<br />
at 70% of your last earned gross wages. You can receive a sickness benefit<br />
f<strong>or</strong> up to two years.<br />
What you have to do <strong>in</strong> return f<strong>or</strong> receiv<strong>in</strong>g a sickness benefit<br />
You are expected to do everyth<strong>in</strong>g with<strong>in</strong> your power to go back to w<strong>or</strong>k as<br />
soon as possible. Your employer <strong>and</strong> the occupational health <strong>and</strong> safety<br />
service (<strong>or</strong> UWV) can help you with this. Together, you can determ<strong>in</strong>e what you<br />
can still do. It is imp<strong>or</strong>tant that you comply with the rules f<strong>or</strong> rep<strong>or</strong>t<strong>in</strong>g sick<br />
<strong>and</strong> receiv<strong>in</strong>g a sickness benefit. Otherwise, your wages <strong>or</strong> sickness benefit<br />
may be reduced.

What happens if you<br />
have been ill f<strong>or</strong> m<strong>or</strong>e<br />
than two years?<br />
Your wages <strong>or</strong> sickness benefit will stop, <strong>and</strong> UWV will decide whether you are<br />
entitled to a Dutch <strong><strong>in</strong>capacity</strong> benefit (WIA benefit). There are two types of<br />
<strong><strong>in</strong>capacity</strong> benefit: a benefit f<strong>or</strong> people who are 100% unfit f<strong>or</strong> w<strong>or</strong>k, <strong>and</strong> a<br />
benefit f<strong>or</strong> people who are still partially able to w<strong>or</strong>k.<br />
UWV will primarily look at what you can still do, how much you could still earn<br />
<strong>and</strong> by what amount your wages would go down. This will determ<strong>in</strong>e what<br />
type of benefit you will get <strong>and</strong> how much you will get. Dutch <strong><strong>in</strong>capacity</strong><br />
benefits are paid by UWV.<br />
Will you rema<strong>in</strong> covered<br />
by social <strong>in</strong>surance if<br />
you become ill <strong>or</strong><br />
<strong>in</strong>capacitated f<strong>or</strong> w<strong>or</strong>k?<br />
You will rema<strong>in</strong> <strong>in</strong>sured <strong>in</strong> the Netherl<strong>and</strong>s as long as you receive wages <strong>or</strong> a<br />
sickness benefit. This means that you will cont<strong>in</strong>ue to build up rights to an<br />
AOW old age pension, be eligible f<strong>or</strong> child benefit <strong>and</strong> be covered by health<br />
<strong>in</strong>surance. However, if you start receiv<strong>in</strong>g a WIA <strong><strong>in</strong>capacity</strong> benefit after 104<br />
weeks, your <strong>in</strong>surance <strong>in</strong> the Netherl<strong>and</strong>s will stop. F<strong>or</strong> m<strong>or</strong>e <strong>in</strong>f<strong>or</strong>mation, see<br />

You will then receive a partial <strong><strong>in</strong>capacity</strong> benefit both from the Netherl<strong>and</strong>s<br />
<strong>and</strong> <strong>Belgium</strong>, the amount of which will depend on the number of years you<br />
have w<strong>or</strong>ked <strong>in</strong> each country. F<strong>or</strong> m<strong>or</strong>e <strong>in</strong>f<strong>or</strong>mation about this, contact the<br />
Bureau f<strong>or</strong> Belgian Affairs.<br />
Tax<br />
You will rema<strong>in</strong> liable to pay tax <strong>in</strong> the Netherl<strong>and</strong>s dur<strong>in</strong>g the first two years<br />
of illness. If you do not return to w<strong>or</strong>k <strong>and</strong> start receiv<strong>in</strong>g a WIA <strong><strong>in</strong>capacity</strong><br />
benefit, you will be liable to pay tax <strong>in</strong> <strong>Belgium</strong>.
