XALTENBRUNNER, Chief' of Sipo and SD: Requests <strong>for</strong> custody orders<br />
are made to Amt IV A 6 h by the BdSuS.15 (Regional Conxtander of the<br />
Security Police- .And Security . Service) the Gestapo(leit)stellen<br />
(Regional District HQ of the Secret State Police), the IdSo.SD<br />
(Inspector of Security Police and Security Service) and the BSSPf<br />
(Superior SS and Police Leader) in the region or district where the<br />
offender was apprehended. .Amt IV A 6 b then executes the<br />
Schutzhaftbefehl in duplicate and. <strong>for</strong>wards it to the requesting<br />
authority who, in turn, <strong>for</strong>wards a copy to the EL where the individual<br />
is to be confined.. The XL corenits the individual and notifies both<br />
the requesting authority and Aid IV A 6 b that it has carried out<br />
the order. (See Annexe B).<br />
In cases of mass arrests, only.one blanket order is executed<br />
and individual cards are made out on each Hetling by the<br />
Sachbearbeiter (sub - s ection Chiefs) after the arrests have been made.<br />
• Requests <strong>for</strong> Political Custody Orders must 1:ke accompanied by<br />
the reasons <strong>for</strong> the request. Custody May, in theory, only be -<br />
ordered after the accused has been given a hearing in regard to the<br />
charge made against him.<br />
Amt IV (Gestapoamt of the RSHA) and Staatspolizei(leit)stellen<br />
are authorised to order the preliminary apprehension of an individual<br />
if it is felt that the person's freedom is prejudicial to the State<br />
or that the individual might attempt to escape. In these cases, the<br />
accused must have the chargelaid against him within twenty-four<br />
hours of apprehension and is to be released, at the latest, ten- days<br />
from the date of apprehensionf if, in the meantime, orders <strong>for</strong> his<br />
custody have not been given 1.7 the proper authority.<br />
Custody orders, made out in writing, must be presentea .to the<br />
accused within . one day after issue .. The following regulations are<br />
applicable: •<br />
•1) The order must specify the reason <strong>for</strong> the action<br />
ii) The next of kin are to be in<strong>for</strong>med of the order, unless it<br />
is considered inexpedient<br />
iii) If custody is ordered <strong>for</strong> a Beamte- kCivil Servant) , his<br />
department is to be notified of the order, and the reasons<br />
<strong>for</strong> it, by the Gestapo office concerned<br />
iv) If custody is ordered <strong>for</strong> a member of the NSDAP or any of<br />
its <strong>for</strong>mations, the relevant Party HQ is in<strong>for</strong>med of the<br />
action by the Gest,a.po office concerned.<br />
Custody lasts <strong>for</strong> whatever period is thought necessary. Release<br />
from custody is also ordered by Amt IV. Release is to follow not<br />
more than three days after the period of custody has cane to an end-.<br />
7. Release from Concentration Camps<br />
Details of released prisoners, who are considered. by Camp<br />
Commandants to have the makings of good technicians, are sent to Anxt<br />
D II of the WI/HA. (see para 9) who -then arrange <strong>for</strong> the utilisation<br />
of their labour, usually somewhere other than in the camp where they<br />
were imprisoned.<br />
When a Schutzhaftlina (Person in Protective Custody) has been<br />
-released, he remains under the supervision of the §3.22, or of a V -,<br />
person. He must report regularly and his movements are restricted.<br />
He is <strong>for</strong>bidd.en to meet certain individuals and must be at • home at<br />
