Justice <strong>and</strong> Access to Justice<br />

human rights. 51 The Legal Aid Board has for some years been<br />

exploring ways <strong>of</strong> bringing the not-for-pr<strong>of</strong>it advice sector into<br />

the scheme for providing help with legal problems. This is an<br />

important aspect <strong>of</strong> the plans for the Community Legal Service.<br />

The task <strong>of</strong> co-ordination <strong>of</strong> the different systems for helping<br />

citizens with their legal problems will fall to the new CLS<br />

Partnerships. These partnerships will be between the CLS, local<br />

government <strong>and</strong> other funders <strong>of</strong> advisory services together<br />

with representatives <strong>of</strong> the providers <strong>of</strong> services. As has already<br />

been noted, the partnerships are supposed to identify the level<br />

<strong>of</strong> unmet need for legal services <strong>and</strong> they are supposed then to<br />

map existing provision <strong>of</strong> services <strong>and</strong> to devise improved<br />

networks to plug gaps in local provision <strong>and</strong> better referral<br />

systems to ensure that the person with the problem reaches the<br />

appropriate adviser. Six pioneer areas are testing out the Partnership<br />

concept <strong>and</strong> 40 other local authorities are involved as<br />

Associate Pioneers. 52 Local initiative is to be encouraged but best<br />

practice guidance will be circulated in the hope <strong>of</strong> promoting it<br />

on a nationwide basis.<br />

These plans sound promising, but they raise many questions.<br />

Since there is no compulsion on local authorities to participate<br />

effectively or at all, how can reluctant authorities be made to<br />

play their part? 53 Equally, how can local authorities that are<br />

currently funding legal services be prevented from withdrawing<br />

or reducing such funding when they see that central government<br />

moneys are now to be available? 54 The best way might be<br />

to put local authorities under a statutory obligation to fund<br />

advice provision similar to the duty under the Housing Act 1996<br />
