focus is keeping one's franchise. The challenge for the new<br />

Legal Services Commission, shortly to replace the Legal Aid<br />

Board, is finding a way to balance the need, on the one h<strong>and</strong>, for<br />

fund holders to be efficient <strong>and</strong> accountable <strong>and</strong>, on the other, to<br />

promote an environment that permits them also to provide<br />

genuine, as opposed to merely paper, quality <strong>of</strong> service.<br />

There are so many important current developments affecting<br />

criminal justice that it is difficult to keep abreast <strong>of</strong> them <strong>and</strong><br />

even more difficult sometimes to be sure whether they are to be<br />

welcomed or deplored. It is clear that some <strong>of</strong> the reforms are<br />

driven primarily by the Treasury's voracious appetite for cost<br />

cutting. Where money is to be saved, justice is liable to be at<br />

risk. But the fact that money is to be saved or that other<br />

efficiency gains are in prospect does not in itself prove that the<br />

proposed reform should be opposed by right thinking citizens.<br />

The best interests <strong>of</strong> defendants, <strong>of</strong> lay witnesses, <strong>of</strong> victims <strong>of</strong><br />

crime, <strong>of</strong> jurors may also be served by improvements in the<br />

operation <strong>of</strong> the system. Certainly no one who has worked in<br />

the criminal justice system could deny that there is room for<br />

improvement in that regard.<br />

After due allowance has been made for the objective that the<br />

system should run efficiently <strong>and</strong> economically, an even greater<br />

concern is that it should be so organised as to reflect the right<br />

balance between the proper interests <strong>of</strong> the prosecution <strong>and</strong> the<br />

proper interests <strong>of</strong> the defence. Experience suggests that striving<br />

to achieve that right balance is a task that will always defeat<br />

us—whatever balance is achieved there will always be someone<br />

calling for it to be changed. So the work <strong>of</strong> adjusting the balance<br />

is never done.<br />
