3. “Right to Health” as a Universal Human Right Norm Almost all universal instruments of human rights have identified and expressed the values of human rights for advancing health of the people. Article 25 of the Universal Declaration of Human Rights (UDHR) enumerates that "Everyone has the right to a standard of living adequate for the health of himself and of his family, including food, clothing, housing and medical care and necessary social services". According to Article 12 of the International Covenant on Economic Social and Cultural Rights (ICESCR), the States parties recognize the right of everyone to the enjoyment of the highest attainable standard of physical and mental health. Under this Covenant States parties should take steps to achieve the full realization of this right by the provision for the reduction of the stillbirth-rate and of infant mortality and for the healthy development of the child; the improvement of all aspects of environmental and industrial hygiene; the prevention, treatment and control of epidemic, endemic, occupational and other diseases and the creation of conditions which would assure to all medical service and medical attention in the event of sickness. State party is also under an obligation to protect, respect and fulfill the right to health within their jurisdictions. The obligation to respect implies a duty of the state not to 4 violate the right to health by its actions . The obligation to protect implies a duty of the state to prevent violations of the right to health by others. It must take measures which prevent third parties from interfering with or 5 violating the right to health . The obligation to fulfill means that 6 governments must act in order to ensure those rights can be enjoyed . 4 The state must refrain from denying or limiting equal access for all persons, including prisoners, detainees, minorities, asylum seekers and illegal immigrants; the state must refrain from censoring, withholding or intentionally misrepresenting accurate healthrelated information, including sexual health education and information. HRI\GEN\1\Rev.1 at 45 (1994) 5 The government must introduce and enforce appropriate controls for the marketing of medical equipment and medicines by third parties; the government must ensure that medical practitioners and other health professionals meet appropriate recognized standards of education, skill and ethical codes of conduct. . For example, it should allocate sufficient public resources to the most deprived regions in the country, in particular to the poor and otherwise vulnerable and disadvantaged groups.
