1856; and then, owing to the vast amount <strong>of</strong> litigation to which<br />

the will gave rise, the fortune to which the beneficiaries succeeded<br />

was <strong>of</strong> only moderate dimensions, so that the danger in that particular<br />

case did not arise. But in the meantime, even before the<br />

will was ultimately pronounced valid by the House <strong>of</strong> Lords, the<br />

Accumulations Act, 1800, was passed in order to prohibit the<br />

creation <strong>of</strong> such a trust for the future.<br />

The Accumulations Act, 1800, s. 1, provides that no person<br />

.... shall .... settle or dispose <strong>of</strong> any real or personal property,<br />

so .... that the rents, issues, pr<strong>of</strong>its or produce there<strong>of</strong><br />

shall be wholly or partially accumulated for any longer term<br />

than—<br />

(a) The life <strong>of</strong> any such grantor or settlor; or<br />

(b) The term <strong>of</strong> twenty-one years from the death <strong>of</strong> such<br />

grantor, settlor, or testator ; or<br />

(c) During the minority or respective minorities <strong>of</strong> any person<br />

or persons who shall be living or en rent re sa mere at the time <strong>of</strong><br />

the death <strong>of</strong> such grantor, settlor, or testator; or<br />

(d) During the minority or respective minorities only <strong>of</strong> any<br />

person or persons who under the .... trusts .... directing<br />

such accumulations would for the time being, if <strong>of</strong> full age, be<br />

entitled to the rents .... or annual produce so directed to be<br />

accumulated.<br />

And where any accumulation is directed otherwise, the direction<br />

shall be null and void. ....<br />

By s. 2, however, an exception is made in favour <strong>of</strong> provisions—<br />

(1) for payment <strong>of</strong> debts,<br />

(2) for raising portions, or<br />

(3) touching the produce <strong>of</strong> timber,<br />

all <strong>of</strong> which may be made as if the Act had not been passed.<br />

The Act has been amended by the Accumulations Act, 1892,<br />

which prohibits accumulations for the purchase <strong>of</strong> land only for<br />

any longer period than during the minority or respective minorities<br />

<strong>of</strong> any person or persons who under the trusts directing such<br />

accumulation would for the time being, if <strong>of</strong> full age, be entitled<br />

to receive the income so directed to be accumulated.<br />

If a trust <strong>of</strong>fends the rule against perpetuities it is void<br />

altogether; if it exceeds the limits <strong>of</strong> the Accumulation Acts it is<br />

good pro tanto. (Griffiths v. Vere (1863), 9 Yes. 127.)
