刑 事 檢 控 科 在 2006 年 公 布 《 檢 控 涉 及 家 庭 暴 力 案 件 的

The Prosecutions Division issued The Policy for Prosecuting
Cases involving Domestic Violence (‘The Policy’) in 2006.
In its first full year of operation, The Policy contributed to a
better deal for the victims of domestic violence. Apart from
setting benchmarks for prosecutors and encouraging best
practice in the treatment of victims, it advanced transparency
in an area of public concern and alerted victims to their
rights. The Policy complemented The Statement on the
Treatment of Victims and Witnesses (2004), which guides
prosecutors in their dealings with others, and is designed to
promote public confidence in criminal justice.

Mr John Reading, SC, DDPP, Policy Co-ordinator on Victims
Rights, addresses the ACPF Silver Jubilee and Symposium, in
Tokyo, on ‘Home without Crime’ on 3 October 2007.
The Policy is a practical guide, which places
those affected by domestic violence at the
heart of our approach to prosecuting. It
recognises that justice is the right of those
who are abused in a domestic context. In
2007, The Policy guided prosecutors in their
dealings with others, both at the advisory
stage and at court. Apart from explaining
domestic violence and the role of the
prosecutor, The Policy considers charging
practice, encourages the avoidance of delay,
examines the position of the victim, prioritises
victim support, reviews the use of bind-over
orders, and seeks appropriate levels of
sentencing for offenders.

In July, Mr Patrick Cheung, SADPP, Head of
the Vulnerable Witness Team, explained to the Panel on
Welfare Services of the Legislative Council the parameters
within which the prosecutor operates in cases of domestic
violence. He said that before initiating a prosecution, it was
necessary to ‘bear in mind the effect of prosecution on other
members of the family’. In October, Mr John Reading, SC,
DDPP, Policy Co-ordinator on Victims Rights, discussed
domestic violence with legislators, and said that ‘the
public interest will normally require that a prosecution be
brought in a case of domestic violence if there is sufficient
evidence to provide a reasonable prospect of conviction
and the victim is willing to give evidence’.
In October, the Policy Co-ordinator participated in the Silver
Jubilee of the Asia Crime Prevention Foundation, in Tokyo,
and considered family violence in the commemorative
