Since the Prosecutions Division created its Computer Crime
Team (CCT) in 1999, the CCT has contributed to strategies
to combat technology crime, advised law enforcers upon
their investigations, promoted best practice in relation
to computer forensics, and liaised with its counterparts
in other jurisdictions to combat cyber crime. The CCT
shares its experiences with others in government, and
applies latest techniques in the prosecution of offenders.
In April, Microsoft described the CCT as ‘one of the elite
hi-tech crime prosecution units in the region’.
Headed by Mr Richard Turnbull, SADPP, Policy Coordinator
on Computer Crime, the CCT applied a fourpronged
approach to technology crime in 2007. At
the international level, close liaison was maintained
with experts from elsewhere. Advice was given to
policy makers upon the development of local laws, and
the Policy Co-ordinator advised upon the Unsolicited
Electronic Messages Ordinance, designed to stem
spam e-mails, text messages, pre-recorded calls, faxes
and video and audio messages. The CCT advised the
technology crime teams of the law enforcement agencies
upon their investigations. At court, the CCT marshalled
its evidence with precision and clarity.
Typical cases prosecuted by the CCT included crimes
against computers, such as hacking and damage, crimes
using computers, such as online fraud and phishing,
and conventional crimes, such as unlawful Internet
gambling and accessing/publishing pornography. The
courts have indicated that non-custodial sentences are
ordinarily inappropriate where there is computer hacking
and economic harm caused by damage to computer
software, and prosecutors were vigilant in defence of
our systems.
In August, the Policy Co-ordinator addressed the 4th
Asia and Pacific Regional Conference of the International
Association of Prosecutors, in Kuala Lumpur, the theme of
which was ‘Computer Crime’. He said that the revolution
in information technology had changed society, that
criminal conduct had become more far-reaching, and
that ‘prosecutors must keep abreast of technological
developments’. Mr Turnbull explained that the challenges
facing law enforcers included : legislative problems;
technical challenges to finding evidence; international
dimensions; searching computers without warrants; postarrest
searches of electronic devices; format of search
warrants; admission of digital evidence.
