(“ 環 保 署 ”) 中 央 檢 控 組 合 力 執 行 法 例 , 保 障 市 民 的 健 康
和 福 祉 。 年 內 , 本 科 為 環 保 署 人 員 提 供 專 業 培 訓 ; 中 央

訂 。 因 違 反 《 空 氣 污 染 管 制 條 例 》、《 海 上 傾 倒 物 料 條
例 》、《 環 境 影 響 評 估 條 例 》、《 噪 音 管 制 條 例 》、
《 保 護 臭 氧 層 條 例 》、《 廢 物 處 置 條 例 》 及 《 水 污 染
管 制 條 例 》 而 被 檢 控 的 案 件 , 在 2007 年 共 有 479 宗 , 在
2006 年 有 341 宗 , 而 在 2005 年 則 有 297 宗 。 至 於 法 庭 判
處 的 罰 款 總 額 , 在 2007 年 為 4,585,400 元 , 在 2006 年 為
3,281,000 元 , 而 在 2005 年 則 為 2,698,000 元 。

排 放 物 所 造 成 , 問 題 引 起 廣 泛
Hong Kong is committed to the protection of the
environment, and to ensuring a quality lifestyle for its
residents. Those who violate environmental laws are
liable to prosecution, and the Prosecutions Division
works with the Central Prosecution Unit (CPU) of the
Environmental Protection Department (EPD) to enforce
the legislation which safeguards the health and welfare
of the community. In 2007, the Division supplied the EPD
personnel with dedicated training, and the CPU applied
the prosecution policy guidelines devised for it by the
Division in the conduct of its cases.
Throughout 2007, Ms Olivia Tsang, SGC(Ag), advised
the EPD upon its investigations and prosecutions, and
considered legislative changes. In total, 479 cases
were prosecuted for violations of the Air Pollution
Control Ordinance, the Dumping at Sea Ordinance,
the Environmental Impact Assessment Ordinance, the
Noise Control Ordinance, the Ozone Layer Protection
Ordinance, the Waste Disposal Ordinance and the Water
Pollution Control Ordinance. That compared with 341
such cases in 2006, and 297 such cases
in 2005. The fines imposed by the courts
in 2007 totalled $4,585,400, compared
with $3,281,000 in 2006, and $2,698,000
in 2005.

The Air Pollution Control Ordinance was
vigorously enforced by prosecutors in
2007. Air pollution is a cause of concern,
and arises mainly from the emissions of
power plants, motorised vehicles and
cross boundary sources.
Owners of
premises which discharge noxious or
offensive emissions are liable to fines of
up to $200,000 and imprisonment for 6
months. Whereas in 2005 fines which
totalled $513,600 were imposed on those
who violated the Ordinance, the figure
for 2006 was $954,800, and for 2007
was $991,200. In 2007, there were 214
prosecutions for offences under this legislation.
