International Fuel Gas Code and Chapter 24 of the International Residential Code. For such purposes,<br />

the building official and the director of public health shall have the powers of a law enforcement officer.<br />

The building official shall have the power to render interpretations of this code and to adopt and<br />

enforce rules and supplemental regulations in order to clarify the application of its provisions. Such<br />

interpretations, rules and regulations shall be in conformance with the intent and purpose of this code.<br />

<strong>16</strong>.02.200 Duties and powers of building official – Notice and orders. Section 104.3 of the<br />

International Building Code is not adopted. (Ord. 14914 § <strong>16</strong>, 2004).<br />

<strong>16</strong>.02.210 Duties and powers of building official - Right of entry. Section 104.6 of the<br />

International Building Code is not adopted and the following is substituted:<br />

Right of entry (IBC 104.6). The right of entry shall be in accordance with the procedures<br />

specified in K.C.C. <strong>Title</strong> 23. (Ord. 14914 § 18, 2004: Ord. 14111 § 7, 2001: Ord. 12560 § 7, 1996.<br />

Formerly K.C.C. <strong>16</strong>.04.05002).<br />

<strong>16</strong>.02.220 Duties and powers of building official – Alternative materials designs and<br />

methods of construction and equipment. Section 104.11 of the International Building Code is not<br />

adopted and the following is substituted:<br />

Alternative materials designs and methods of construction and equipment. (IBC 104.11).<br />

The provisions of this code are not intended to prevent the installation of any material or to prohibit any<br />

design or method of construction not specifically prescribed by this code, provided that any such<br />

alternative has been approved. An alternative material, design or method of construction shall be<br />

approved where the building official finds that the proposed design is satisfactory and complies with the<br />

intent of the provisions of this code, and that the material, method or work offered is, for the purpose<br />

intended, at least the equivalent of that prescribed in this code in quality, strength, effectiveness, fire<br />

resistance, durability and safety. Compliance with the specific performance-based provisions of the<br />

International Codes in lieu of specific requirements of this code shall also be permitted as an alternate.<br />

(Ord. 14914 § 19, 2004).<br />

<strong>16</strong>.02.230 Annual permit and annual permit records. Sections 105.1.1 and 105.1.2 of the<br />

International Building Code are not adopted. (Ord. 14914 § 20, 2004).<br />

<strong>16</strong>.02.240 Permits - Work exempt from permit. Section 105.2 of the International Building<br />

Code is not adopted and the following is substituted:<br />

Work exempt from permit (IBC 105.2). A building permit shall not be required for the following:<br />

Building:<br />

1. One-story detached one and two family residential accessory buildings used as tool and<br />

storage sheds, playhouses, tree supported structures used for play and similar uses, not including<br />

garages or other buildings used for vehicular storage, provided the floor area does not exceed 200 square<br />

feet (11.15 m2) provided that the roof overhang does not exceed twenty-four inches measured horizontally<br />

from the exterior wall.<br />

2. One-story detached agricultural and forestry accessory buildings used as animal shelters or<br />

sheds for the storage of tools, animal feed, animal bedding, seeds, seedlings or similar materials or<br />

products, not including office, sleeping or resting quarters, garages or buildings used for vehicle storage,<br />

provided the floor area does not exceed 200 square feet (11.15 m2) provided that the roof overhang does<br />

not exceed twenty-four inches measured horizontally from the exterior wall.<br />

3. Fences not over 6 feet (1.829 m) high.<br />

4. Oil derricks.<br />

5. Retaining walls that are not over 4 feet (1.219 m) in height measured from the bottom of the<br />

footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or III-A liquids.<br />

6. Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons<br />

(18,927 l) and the ratio of height to diameter or width does not exceed 2 to 1.<br />

7. Platforms, sidewalks and driveways not more than 30 inches (.762 m) above grade and not<br />

over any basement or story below and that are not part of an accessible route.<br />

8. Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work.<br />

9. Temporary motion picture, television and theater stage sets and scenery.<br />

10. Prefabricated swimming pools accessory to a Group R, Division 3 Occupancy as applicable in<br />

Section 101.2, that are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (18,925 l) and<br />

are installed entirely above ground.
