<strong>16</strong>.02.270 Permits - Application for permit - Application for basics permit or approval.<br />

Section 105.3 of the International Building Code is supplemented with the following:<br />

Application for basics permit or approval (IBC 105.3.3). Application requirements for basics<br />

permit or approval shall be as specified in <strong>King</strong> <strong>County</strong> Administrative Public Rule. (Ord. 14914 § 27,<br />

2004: Ord. 14111 § 24, 2001: Ord. 12560 § 23, 1996. Formerly K.C.C. <strong>16</strong>.04.05018).<br />

<strong>16</strong>.02.280 Application for permit - Time limitation of application - Expiration of application.<br />

Section 105.3.2 of the International Building Code is not adopted and the following is substituted:<br />

Expiration of application (IBC 105.3.2). Plans for which no permit is issued shall be deemed<br />

canceled by the permittee if:<br />

1. The applicant has not taken action or responded;<br />

1.1. within 60 days after notice of additional information required is mailed to the applicant, or<br />

1.2. by the deadline specified by the building official for additional information; or<br />

2. No permit is issued;<br />

2.1. within 60 days after the applicant has been notified that the permit is ready, or<br />

2.2. by a time specified by the building official. (Ord. 14914 § 29, 2004: Ord. 14111 § 18, 2001:<br />

Ord. 12560 § 17, 1996. Formerly K.C.C. <strong>16</strong>.04.05012).<br />

<strong>16</strong>.02.290 Permits - Expiration. Section 105.5 of the International Building Code is not adopted<br />

and the following is substituted:<br />

Expiration (IBC 105.5). Every permit issued by the building official under the provisions of the<br />

Code shall expire by limitation and become null and void one year from date of issue. Issued permits may<br />

be extended for one year periods subject to the following conditions:<br />

1. An application for a permit extension together with the applicable fee is submitted to the<br />

department at least seven (7), but no more than sixty (60), calendar days prior to the date the original<br />

permit becomes null and void. Once the permit extension application is submitted, work may continue<br />

past the expiration date of the original permit, provided that the extension application is not denied. If the<br />

extension application is denied, all work must stop until a valid permit is obtained.<br />

2. If construction of a building or structure has not substantially commenced, as determined by<br />

the building official, within two years from the date of the first issued permit and the building and the<br />

structure is no longer authorized by the zoning code or other applicable law, then the permit shall not be<br />

extended.<br />

3. An applicant may request a total of two permit extensions provided there are no substantial<br />

changes in the approved plans and specifications.<br />

4. The building official may extend a building permit beyond the second extension only to allow<br />

completion of a building, structure or mechanical system authorized by the original permit and<br />

substantially constructed. If substantial work, as determined by the building official, has not commenced<br />

on a building and/or structure authorized in the original permit, then a new permit will be required for<br />

construction to proceed.<br />

Exception: Until December 31, 2012, the building official may grant a third or fourth extension for<br />

building permits where substantial work has not commenced, if:<br />

1. The applicant makes a written request to the building official for an extension of the building<br />

permit;<br />

2. The applicant pays applicable permit extension fees; and<br />

3. There are no substantial changes in the approved plans or specifications.<br />

5. The staff of the department may revise a permit at the permittee's request but such a revision<br />

does not constitute a renewal or otherwise extend the life of the permit. (Ord. 17420 § 49, 2012: Ord.<br />

<strong>16</strong>.02.300 Permits - Suspension or revocation. Section 105.6 of the International Building<br />

Code is not adopted and the following is substituted:<br />

Suspension or revocation (IBC 105.6). The building official is authorized to suspend, revoke or<br />

modify the permit approval for a permit issued under the provisions of this code wherever the permit is<br />

issued in error or on the basis of incorrect, inaccurate or incomplete information, or in violation of any<br />

ordinance or regulation or any of the provisions of this code. (Ord. 14914 § 32, 2004).<br />

<strong>16</strong>.02.310 Permits - Return of plans. Section 105 of the International Building Code is<br />

supplemented with following:<br />

Return of plans (IBC 105.8). Any plans returned pursuant to Section 105 shall be returned to the<br />

applicant. Plans returned for the purpose of making correction may be returned to a consultant named by
