1. If any building is declared a substandard building under this ordinance, it shall either be<br />

repaired in accordance with the current Building Code or shall be demolished at the option of the building<br />

owner.<br />

2. If the building or structure is in such condition as to make it immediately dangerous to the life,<br />

limb, property or safety of the public or the occupants, it shall be ordered to be vacated and secured from<br />

entry.<br />

3. A building declared a dangerous building under this code shall either be repaired in<br />

accordance with the current building code, except structures damaged as a result of a disaster when the<br />

executive has declared an emergency, which shall comply with K.C.C. chapter <strong>16</strong>.06, K.C.C. 17.04.600<br />

and 17.04.620; or shall be demolished at the option of the building owner.<br />

4. If the nuisance located on the premises is in such condition as to make it immediately<br />

dangerous to the life, limb, property or safety of the public, or its occupants, it shall be ordered to be<br />

removed, abated or vacated and secured from entry. (Ord. 14914 § 351, 2004: Ord. 14111 § 144, 2001:<br />

<strong>16</strong>.14.140 Unsafe structures, premises and equipment - General. Section 108.1 of the<br />

International Property Maintenance Code is not adopted and the following is substituted:<br />

General (IPMC 108.1). When a structure, equipment or premises are found by the code official to<br />

be unsafe, or when a structure is found unfit for human occupancy, or is found unlawful, such structure,<br />

equipment or premises shall be condemned pursuant to the provisions of this code. (Ord. 14914 § 352,<br />

2004).<br />

<strong>16</strong>.14.150 Unsafe structures, premises and equipment - Unsafe structures and premises.<br />

Section 108.1.1 of the International Property Maintenance Code is not adopted and the following is<br />

substituted:<br />

Unsafe structures and premises (IPMC 108.1.1). An unsafe structure or premise is one that is<br />

found to be dangerous to the life, health, property or safety of the public or the occupants of the structure<br />

by not providing minimum safeguards to protect or warn occupants in the event of fire, or because such<br />

structure or premises contain unsafe equipment or is so damaged, decayed, dilapidated, structurally<br />

unsafe or of such faulty construction or unstable foundation, that partial or complete collapse is possible.<br />

(Ord. 14914 § 353, 2004).<br />

<strong>16</strong>.14.<strong>16</strong>0 Unsafe structures, premises and equipment - Unsafe equipment. Section 108.1.2<br />

of the International Property Maintenance Code is not adopted and the following is substituted:<br />

Unsafe equipment (IPMC 108.1.2). Unsafe equipment includes any boiler, heating equipment,<br />

elevator, moving stairway, electrical wiring or device, flammable liquid containers or other equipment on<br />

the premises or within the structure which is in such disrepair or condition that such equipment is a hazard<br />

to life, health, property or safety of the public or occupants of the premises or structure. (Ord. 14914 §<br />

354, 2004).<br />

<strong>16</strong>.14.170 Unsafe structures, premises and equipment - Structure unfit for human<br />

occupancy. Section 108.1.3 of the International Property Maintenance Code is not adopted and the<br />

following is substituted:<br />

Structure unfit for human occupancy (IPMC 108.1.3). A structure is unfit for human occupancy<br />

whenever the code official finds that such structure is unsafe, unlawful or, because of the degree to which<br />

the structure is in disrepair or lacks maintenance, is unsanitary, vermin or rat infested, contains filth and<br />

contamination, or lacks ventilation, illumination, sanitary or heating facilities or other essential equipment<br />

required by this code, or because the location of the structure constitutes a hazard to the occupants of the<br />

structure or to the public. (Ord. 14914 § 355, 2004).<br />

<strong>16</strong>.14.180 Unsafe structures, premises and equipment - Structure unfit for human<br />

occupancy - Placarding. Section 108.1.3 of the International Property Maintenance Code is<br />

supplemented with the following:<br />

Placarding (IPMC 108.1.3.1). In addition to being served as provided in K.C.C. <strong>Title</strong> 23, a notice<br />

to vacate or abate as nuisance may be posted at or upon each exit of the building or upon the premises<br />

where the exits exist in substantially the following form:<br />

KING COUNTY DEPARTMENT OF PERMITTING <strong>AND</strong> ENVIRONMENTAL REVIEW<br />

[DEPARTMENT ADDRESS]<br />

NOTICE IS HEREBY GIVEN THAT THIS <strong>BUILDING</strong><br />

MUST NOT BE OCCUPIED
