address of the location of the work being done, or at the address of the place of business of the person<br />

being served. The taxpayer’s address as shown on the tax records of the county shall be deemed to be<br />

the proper address for the purpose of mailing such notice to the person being served. Service by mail<br />

shall be presumed effective upon the third business day following the day upon which the stop work order<br />

was placed in the mail.<br />

B. Whenever any work is being done contrary to the provisions of this code, the authority having<br />

jurisdiction may order the violations corrected without ordering all work stopped by issuing a correction<br />

notice that identifies the violation. The correction notice may require an inspection before further<br />

construction or at the time of the next required inspection. The correction notice shall be served or posted<br />

in the same manner as a stop work order.<br />

C. The remedies set forth in this section are in addition to those authorized elsewhere in this<br />

code. (Ord. 15802 § 124, 2007).<br />

<strong>16</strong>.32.225 Authority to Correct Hazardous or Insanitary Plumbing. Section 102.2.5 of the<br />

Uniform Plumbing Code is not adopted and the following is substituted:<br />

Authority to Correct Hazardous or Insanitary Plumbing (UPC 102.2.5). Whenever the<br />

authority having jurisdiction ascertains that any plumbing system or portion thereof, regulated by this code,<br />

has become hazardous to life, health, property, or has become insanitary, the authority having jurisdiction<br />

shall order in writing that such plumbing either be removed or placed in a safe or sanitary condition, as<br />

appropriate. The order shall fix a reasonable time limit for compliance. No person shall use or maintain<br />

defective plumbing after receiving such notice.<br />

When such plumbing system is to be disconnected, written notice shall be given. In cases in<br />

which the authority having jurisdiction has determined that immediate danger to life or property exists, the<br />

authority having jurisdiction may cause such disconnection to be made immediately without such notice.<br />

(Ord. 15802 § 125, 2007).<br />

<strong>16</strong>.32.235 Liability Claims. Section 102.2.6 of the Uniform Plumbing Code is not adopted and<br />

the following is substituted:<br />

Liability Claims (UPC 102.2.6). This code is enacted as an exercise of the police power of <strong>King</strong><br />

<strong>County</strong> to protect and preserve the public peace, health, safety and welfare, and its provisions shall be<br />

liberally construed for the accomplishment of these purposes. It is expressly the purpose of this code to<br />

provide for and promote the health, safety and welfare of the general public, and not to create or otherwise<br />

establish or designate any particular class or group of persons who will or should be especially protected<br />

or benefited by the terms of this code.<br />

It is the specific intent of this code to place the obligation of complying with its requirements upon<br />

the owner or occupier of premises within this code's scope, and no provision nor term used in this code is<br />

intended to impose any duty whatsoever upon the authority having jurisdiction or any of the authority<br />

having jurisdiction's officers or employees, for whom the implementation or enforcement of this code shall<br />

be discretionary and not mandatory.<br />

Nothing in this code creates or forms the basis for any liability on the part of the authority having<br />

jurisdiction, or the authority having jurisdiction's officers, employees or agents, for any injury or damage<br />

resulting from the failure of the owner or occupier of premises to comply with the provisions of this code,<br />

or by reason or in consequence of any act or omission in connection with the implementation or<br />

enforcement of this code on the part of the authority having jurisdiction or by the authority having<br />

jurisdiction's officers, employees or agents.<br />

Any claim or litigation arising from any conduct, acts or omissions of the authority having<br />

jurisdiction, or any of the authority having jurisdiction's officers, employees or agents, shall be subject to<br />

the provisions of K.C.C. chapters 4.12 and 4.13*. (Ord. 15802 § 126, 2007).<br />

*Reviser’s note: K.C.C. chapter 4.12 was mostly recodified as K.C.C. chapter 2.21, and K.C.C. chapter 4.13 was repealed, by<br />

Ordinance 17408, 2012.<br />

<strong>16</strong>.32.245 Violations. Section 102.3.1 of the Uniform Plumbing Code is not adopted and the<br />

following is substituted:<br />

Violations (UPC 102.3.1). It shall be unlawful for any person, firm, corporation or other entity to<br />

erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, or maintain<br />

any plumbing or permit the same to be done in violation of this code. (Ord. 15802 § 127, 2007).<br />

<strong>16</strong>.32.255 Penalties. Section 102.3.2 of the Uniform Plumbing Code is not adopted and the<br />

following is substituted:<br />

Penalties (UPC 102.3.2). Any person, firm, corporation or other entity violating any provision of<br />

this code shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a<br />

fine and/or imprisonment in accordance with K.C.C. <strong>Title</strong> 23 or state law. Each separate day or any
