All copies of the tender paper shall be signed in ink by the tenderer, on each page including closing page, in token of his having studied the tender papers carefully. 1.2.13 The intending tenederer is advised to study the tender papers carefully. Any submission of a quotation by the tenderer shall be deemed to have been done after a careful study and examination of these documents with full understanding of the implication thereof. These conditions and specifications shall be deemed to have been accepted unless otherwise, specifically commented upon by the tenderer in his quotation. Failure of adhere to anyone or all these instructions may render his offer liable to be ignored without any reference. 1.2.14 Should a tenderer find discrepancies or omission from the drawing or any of the tender papers or he has any doubt to their meaning, he should at once notice the Railway who may send a written clarification to all tenderer(s). 1.2.15 ADDRESS FOR COMMUNICATION :- Tenderer shall indicate his postal address, telephone numbers, telegraphic address, if any, and telex/fax numbers. Any communication sent to the tenderer(s) at his said address, shall be deemed to have reached timely, not withstanding the fact that the communication could not reach the tenderer at all or in time because of any inaccuracy or defect in the said address. Any change thereof shall be advised to Railway promptly. 1.3 EARNEST MONEY: 1.3.1 The tenderer(s) is/are required to deposit with the Divisional Cashier / Con. / N. E. Railway/Gorakhpur in favour of FA&CAO/CON/ N.E. RLY/Gorakhpur a sum prescribed money as Earnest Money, and the receipt obtained thereof should be enclosed with the tender as a proof of the deposit of the requisite Earnest Money 1.3.2 The Earnest Money can also be deposited in any of the following forms in favour of FA&CAO/CON/N. E. RAILWAY/Gorakhpur, in lieu of Cash. In such case the validity / currency (if applicable) should be at least three months beyond the date of validity of offer. (i) Deposit Receipt, Pay Order, and Demand Draft. These forms of Earnest Money should be either of The State Bank of India or any other Nationalized Banks. No confirmatory advice from the Reserve Bank of India will be necessary. (ii) Deposit Receipt executed by the scheduled banks (other than the State Bank of India and 8 Nationalized Bank) approved by the Reserve Bank of India for the purpose. (iii) Deposit Receipt tendered by the scheduled bank which have not been approved by Reserve Bank of India for the purpose provided : Signature of Tenderer(s) Date………………… 8
Dy.CSTE/Con/ IZN/02 of 2011 North Eastern Railway a) The bond in question is countersigned by any of the approved bank (including the State Bank of India) whereby the later undertake full responsibility to indemnify the N. E. Railway in case of default. or b) The bank concerned lodged with the Reserve Bank of India requisite securities , namely cash deposits of Government securities in respect of the guarantees to be executed or deposit receipts to be tendered by it. Apart from the above provisions, prior concurrence of the Reserve Bank of India, in writing should be necessary before accepting Deposit Receipts under (iii) (a), (b). Government securities (stock certificates, bearer bonds, promissory notes, cash certificate etc.) will not be accepted. 1.3.3 Tender un accompanied by the requisite earnest money will be summarily rejected. If the deposit receipt for earnest money is not in any of the prescribed forms as stipulated in Para 1.3.2 above, the tender will be considered as un accompanied by requisite earnest money, and hence will be summarily rejected. 1.3.4 The tenderer(s) shall hold the offer open for a period of at least 120 days (One Hundred Twenty days) from the date fixed for opening the same. It is understood that the tender documents have been sold/issued to the tenderer in consideration of the stipulation on his part that after submitting his tender. He will not resile from his offer or modify the terms and conditions thereof in a manner not acceptable to the Railway. Should the tenderer fail to observe or comply with the foregoing stipulation the whole amount of Earnest Money shall be liable to be forfeited by the Railway. 1.3.5 The earnest money will be refunded to the unsuccessful tenderer/ tenderer(s) within a reasonable time but the railway shall not be responsible for any loss or depreciation that may happen to the security for due performance to keep the offer open, or to the earnest money, while in their possession nor be liable to pay interest thereon. The earnest money deposit of the successful tenderer/ tenderer(s) will be retained towards to security deposit for the due and faithful fulfillment of the contract, but shall be forfeited without prejudice to any other rights or remedies, if the, contractor/ contractors fail to execute the agreement bond or to start the work within the periods stipulated . Note: Earnest Money in the form of Guarantee Bond shall not be accepted. Security Deposit 1.4.1 The Earnest Money deposited by the successful tenderer with his tender will be retained by the Railway as part of security deposit for the due and faithful fulfillment of the contract by the contractor. The full security deposit for the work will be calculated as provision of GCC applicable as with up to date corrections if any. The balance amount over and above amount of earnest money may be deposited by the contractor in cash with the Chief Cashier, North Eastern Railway, Gorakhpur or may be recovered from the contractor’s Signature of Tenderer(s) Date………………… 9
