235 Representation of Price/Terms<br />
Oral representations regarding the terms of a sale (especially<br />
the price) that are false, deceptive, or misleading. False<br />
statements concerning the reasons for, existence of, or amounts<br />
of price reductions or increases.<br />
Includes 1) a contradiction between the oral representation<br />
of the terms of a contract and the actual written terms,<br />
. 2) an oral statement of contract terms that is not included<br />
in the written contract in any manner, 3) a misrepresentation<br />
of the terms of an oral agreement, or 4) a misrepresentation<br />
of the authority of a salesman or agent to negotiate the final<br />
terms of a transaction.<br />
EXAMPLES:<br />
* Respondent quotes a price for goods which he says is<br />
20% less than the normal retail price, when actually<br />
the retail price is the price quoted.<br />
* A salesman indicates that the product is a' "sale"<br />
item when the product is actually being sold at<br />
the respondent's usual price.<br />
* Respondent announceSJ a "going-out-of business" sale,<br />
with no intention of doing sd'.<br />
* A salesman tells the buyer he has a la-day return<br />
privilege, when that is neither part of the written<br />
contract nor the seller's policy.<br />
* A salesman overstates the amount actually credited<br />
for the buyer's trade-in.<br />
Do not include representations relating to warranty or credit<br />
