There are no anticipated costs; however, there is some fiscal<br />

impact in the way of anticipated savings to businesses by<br />

can save money for other entities including businesses<br />

involved in real estate transactions with the state.<br />

R23-22. General Procedures for Acquisition and Selling of Real<br />

Property.<br />

R23-22-1. Purpose.<br />

This rule defines the procedures of the Division of<br />

Facilities Construction and Management for acquisition and selling<br />

of real property.<br />

R23-22-2. Authority.<br />

(1) This rule is authorized under Subsection<br />

63A-5-103(1)(e), which directs the Building Board to make rules<br />

necessary for the discharge of the duties of the Division of Facilities<br />

Construction and Management (hereinafter referred to as the<br />

"Division")[ as well as pursuant to H.B. 354 of the 2008 General<br />

Session of the <strong>Utah</strong> Legislature].<br />

(2) This rule is also authorized and intended to implement<br />

the requirements of Section 63A-5-4<strong>01</strong>, as well as Subsection<br />

63A-5-103(1)(e)(iii).<br />

R23-22-3. Policy.<br />

It is the general policy of the Board that, except as<br />

otherwise allowed by the <strong>Utah</strong> Code, the Division shall buy, sell or<br />

exchange real property in accordance with this Rule to ensure that<br />

the value of the real property is congruent with the proposed price<br />

and other terms of the purchase, sale or exchange.<br />

R23-22-4. Scope of This Rule.<br />

This Rule shall apply to all purchases, sales, donations<br />

and exchanges of DFCM, as applicable in this Rule, except as<br />

otherwise allowed by the <strong>Utah</strong> Code. The requirements of this Rule<br />

shall also not apply to a contract or other written agreement prior to<br />

May 5, 2008; or to any contract or to any purchase, sale or<br />

exchange of real property where the value is determined to be less<br />

than $100,000 as estimated by DFCM.<br />

R23-22-5. Requirements for Purchase or Exchanges of Real<br />

Property.<br />

DFCM shall comply with the following in regard to the<br />

purchase or exchange of real property that is subject to this Rule:<br />

(1) DFCM must find that all necessary approvals have<br />

been obtained from State and other applicable authorities. DFCM<br />

will assist other State agencies in obtaining these approvals when it<br />

is deemed by DFCM to be in the interest of the State.<br />

(2) DFCM shall coordinate as required any necessary<br />

financing requirements through the State Building Ownership<br />

Authority, or other relevant bonding authority, as authorized by the<br />

Legislature.<br />

(3) DFCM shall assist other State agencies in accordance<br />

with DFCM's <strong>gov</strong>erning statutes, through financial analysis and<br />

other appropriate means, in selecting the appropriate or particular<br />

real property to be purchased and/or exchanged.<br />

(4) DFCM shall, in accordance with DFCM's <strong>gov</strong>erning<br />

statutes, negotiate, draft and execute the applicable Real Estate<br />

Contract with due consideration to the State agency's comments.<br />

The State agency may be required by DFCM to be a signatory to the<br />

Contract.<br />

(5) DFCM shall obtain and review the following<br />

documents when such is determined by DFCM to be customary in<br />

the industry for the size and type of transaction or if required by<br />

another provision of this Rule or State law:<br />

a. title insurance commitment;<br />

b. an environmental assessment;<br />

c. an engineering assessment;<br />

d. a code review;<br />

e. an appraisal;<br />

f. an analysis of past maintenance and operational<br />

expenses, when available and relevant;<br />

g. the situs, zoning and planning information;<br />

h. an ALTA land survey;[ and]<br />

i. an historic property assessment under Section 9-8-404;<br />

and<br />
