RULE ANALYSIS<br />
PURPOSE OF THE RULE OR REASON FOR THE<br />
CHANGE: The purpose of the Rule is to comply with S.B. 13<br />
of the <strong>2<strong>01</strong>0</strong> <strong>Utah</strong> Legislative Session which enacts Section<br />
63G-6-604. Said statute requires that a state construction<br />
contract impose requirements related to drug and alcohol<br />
testing. This rule addresses penalties for non-compliance;<br />
clarifies that monitoring activities are not required of the state;<br />
provides that the state is not liable in actions related to drug<br />
and alcohol testing; provides exemptions; and addresses the<br />
scope of the provision. (DAR NOTE: S.B. 13 (<strong>2<strong>01</strong>0</strong>) is found<br />
at Chapter 18, Laws of <strong>Utah</strong> <strong>2<strong>01</strong>0</strong>, and will be effective<br />
07/<strong>01</strong>/<strong>2<strong>01</strong>0</strong>.)<br />
SUMMARY OF THE RULE OR CHANGE: S.B. 13 of the<br />
<strong>2<strong>01</strong>0</strong> <strong>Utah</strong> State Legislative Session enacted Section<br />
63G-6-604 and modified the <strong>Utah</strong> Procurement Code to<br />
address requirements for drug and alcohol testing for state<br />
construction contracts. This rule is being implemented to<br />
comply with S.B. 13 and requires that a state construction<br />
contract impose requirements related to drug and alcohol<br />
testing; addresses penalties; clarifies that monitoring activities<br />
are not required of the state; provides that the state is not<br />
liable in actions related to drug and alcohol testing; provides<br />
exemptions and addresses the scope of the provision.<br />
STATUTORY OR CONSTITUTIONAL AUTHORIZATION FOR<br />
THIS RULE: Section 63G-6-604<br />
ANTICIPATED COST OR SAVINGS TO:<br />
♦ THE STATE BUDGET: The statute itself created the fiscal<br />
impacts. The rule does not add additional burdens than<br />
already provided by the statute. The rule will not impact the<br />
costs.<br />
♦ LOCAL GOVERNMENTS: The statute itself created the<br />
fiscal impacts. <strong>No</strong> costs or savings are anticipated for local<br />
<strong>gov</strong>ernments with this new rule. <strong>No</strong> new requirements were<br />
created with this new rule that impact local <strong>gov</strong>ernments.<br />
♦ SMALL BUSINESSES: The statute itself created any fiscal<br />
impacts to small businesses. The implementation of Rule<br />
R33-10 does not add additional burdens than already<br />
provided by the statute.<br />
♦ PERSONS OTHER THAN SMALL BUSINESSES,<br />
BUSINESSES, OR LOCAL GOVERNMENTAL ENTITIES:<br />
The statute itself created any fiscal impacts to persons other<br />
than small businesses, businesses, or local <strong>gov</strong>ernment<br />
entities. The implementation of Rule R33-10 does not add<br />
additional burdens than already provided by the statute.<br />
COMPLIANCE COSTS FOR AFFECTED PERSONS: The<br />
statute itself created any compliance costs, if any, for affected<br />
persons. Implementation of Rule R33-10 does not create any<br />
compliance costs other than those that were created by the<br />
statute.<br />

FISCAL IMPACT THE RULE MAY HAVE ON BUSINESSES:<br />
The purpose of implementing Rule R33-10 is to be in<br />
compliance with S.B. 13, <strong>2<strong>01</strong>0</strong> Legislative Session and state<br />
statute. The statute created the fiscal impacts and<br />
implementation of this rule does not add additional burdens<br />
than already provided by the statute. The rule will not impact<br />
the costs.<br />
