NOTICES OF PROPOSED RULES<br />

R156-31b-605. Nursing Education Program <strong>No</strong>tification of<br />

Change.<br />

(1) Educational institutions wishing to begin a new<br />

nursing education program shall submit an application to the<br />

[d]Division for approval status at least one year prior to the<br />

implementation of the program.<br />

(2) An approved program that expands onto a satellite<br />

campus or implements an outreach program shall notify the<br />

Division at least one semester before the intended change.<br />

R156-31b-607. Innovative Approaches in Nursing Education<br />

Program.<br />

An approved nursing education program may request a<br />

waiver from one or more of the standards established in Section<br />

R156-31b-603 in order to implement an innovative approach to<br />

nursing education.<br />

(1) To be eligible to request a waiver from the education<br />

standards in Section R156-31b-603, a nursing education program<br />

shall:<br />

(a) have full or provisional approval status from the<br />

Division in collaboration with the Board to offer a nursing<br />

education program and be accredited by a nurse accrediting body;<br />

(b) have had no substantiated complaints in the two years<br />

immediately preceding the request for a waiver; and<br />

(c) have no documented rule violations in the two years<br />

immediately preceding the waiver request.<br />

(2) A written request to implement an innovative<br />

approach to nursing education shall be submitted to the Division at<br />

least four months prior to the proposed implementation date. The<br />

request shall include the following:<br />

(a) a one-page executive summary;<br />

(b) identifying information including the name of the<br />

nursing education program, responsible party and contact<br />

information;<br />

(c) a brief description of the current program, including<br />

the nurse accrediting body which has accredited the program and<br />

the status of that accreditation;<br />

(d) identification of the standards affected by the<br />

proposed innovative approach;<br />

(e) length of time for which the innovative approach is<br />

requested;<br />

(f) description of the innovative approach including<br />

objectives;<br />

(g) brief explanation of why the program desires to<br />

implement an innovative approach at this time;<br />

(h) explanation of how the proposed innovation differs<br />

from approaches in the current program;<br />

(i) rationale with available evidence supporting the<br />

innovative approach;<br />

(j) identification of resources that support the proposed<br />

innovative approach;<br />

(k) expected impact the innovative approach will have on<br />

the program, including administration, students, faculty, and other<br />

program resources;<br />

(l) plan for implementation, including timeline;<br />

(m) plan for evaluation of the proposed innovation,<br />

including measurable criteria/outcomes, method of evaluation, and<br />

frequency of evaluation; and<br />

(n) any additional information requested by the Board.<br />

(3) The standards for approval of a request to implement<br />

an innovative approach are established as follows:<br />

(a) the innovative approach will not compromise the<br />

quality of education or safe practice of students;<br />

(b) resources are sufficient to support the innovative<br />

approach;<br />

(c) rationale with available evidence supports the<br />

implementation of the innovative approach;<br />

(d) implementation plan is reasonable to achieve the<br />

desired outcomes of the innovative approach;<br />

(e) timeline provides for a sufficient period to implement<br />

and evaluate the innovative approach; and<br />

(f) plan for periodic evaluation is comprehensive and<br />

supported by appropriate methodology.<br />

(4) The Division in collaboration with the Board may<br />

rescind the approval of an innovative approach or may require a<br />

nursing education program to make modification to the innovative<br />

approach if the Board receives evidence indicating adverse impact,<br />

or the nursing program fails to implement the innovative approach<br />

as presented and approved.<br />

(5) Periodic evaluation shall be conducted by a nursing<br />

program that has implemented an innovative approach. The<br />

evaluations shall include:<br />

(a) submitting progress reports conforming to the<br />

evaluation plan annually or as requested by the Division or Board;<br />

(b) providing documentation of corrective measures and<br />

their effectiveness if any report indicates that students are or were<br />

adversely impacted by the innovative approach; and<br />

(c) maintaining their eligibility as outlined in Subsection<br />

(1).<br />

(6) The program shall submit a final evaluation report<br />

which conforms to the evaluation plan, detailing and analyzing the<br />

outcomes data.<br />

(7) If the innovative approach has achieved the desired<br />

outcomes and the final evaluation has been submitted, the program<br />

may request in writing to have the innovative approach continue, or<br />

the program may request to have the innovative approach become<br />

an ongoing part of the education program.<br />

(8) A nurse accredited education program based solely on<br />

one or more innovative approaches to nursing education may<br />

request to be granted provisional approval status by the Division in<br />

collaboration with the Board under this section and Sections<br />

R156-31b-6<strong>01</strong> and R156-31b-603.<br />

R156-31b-60[7]8. Approved Nursing Education Programs<br />

Located Outside of <strong>Utah</strong>.<br />

(1) In accordance with Section 58-31b-302, an approved<br />

nursing education program located outside of <strong>Utah</strong> must meet the<br />

following requirements in order for a graduate to meet the<br />

educational requirement for licensure in this state:<br />

(a) be accredited by the CCNE, NLNAC or COA; or<br />

(b) be approved by the Board of Nursing or an equivalent<br />

agency in the state in which the nursing education program is<br />

offered.<br />

R156-31b-60[8]9. Standards for Out-of-State Programs<br />

Providing Clinical Experiences in <strong>Utah</strong>.<br />

In accordance with Subsection 58-31b-6<strong>01</strong>(2), the<br />

minimum standards that a nursing education program which is<br />
