application or enforcement of the provisions of this MOU. Only "contract<br />

grievances" have the potential to be arbitrated.<br />

B. A "policy grievance" (a non-arbitrable grievance) is a dispute between one (1) or<br />

more employees against the State, or a dispute between CCPOA and the State<br />

involving the interpretation of a law, policy, rule or procedure involving<br />

employment-related matters not covered in this MOU, not under the jurisdiction<br />

of the State Personnel Board, the contents of a Letter of Instruction (LOI/WID),<br />

the contents of a Performance Report, and alleged POBR violations. Policy<br />

grievances may be processed only to the Director's level of this grievance<br />

procedure unless otherwise stated, and are not arbitrable.<br />

C. A "health and safety" grievance will include, but not be limited to, such matters<br />

as:<br />

1. Unsafe structural conditions;<br />

2. Defective or unsafe mechanical equipment;<br />

3. Defective or unsafe electrical;<br />

4. Health and environmental hazards, including but not limited to contained biohazard<br />

fluids;<br />

5. Vector Control; and<br />

6. Violation of acknowledged custodial rules or procedures which would constitute a<br />

danger of safety to the employee, worksite or the public.<br />

Health and safety grievances shall be filed directly at Step 2, the<br />

Appointing Authority's level.<br />

A. The following are merit system appeals under the jurisdiction of the State<br />

Personnel Board, and are not grievable or arbitrable under this MOU.<br />

Complainants or appellants are placed on notice that these following items should<br />

be appealed directly to the State Personnel Board unless an initial departmental<br />

appeals process has been spelled out in the Youth Authority Administrative<br />

Manual (YAM) or the CDC Departmental Operations Manual (DOM):<br />

1. Exam appeals<br />

2. Adverse Action appeals (Government Code Section 19570 et seq.)<br />

3. Merit complaints<br />

4. Whistle-blower complaints<br />

5. Equal Employment Opportunity complaints (see the YAM or DOM)<br />

6. Appointment appeals<br />

7. Withholds from certification (background investigations)<br />

A. As used in this procedure, the term "immediate supervisor" means the individual,<br />

identified by the Appointing Authority, who assigns, reviews and directs the work<br />

of an employee.<br />

B. As used in this procedure, the term "party" means CCPOA, an employee or the<br />

State.
