At any step of the grievance procedure, CCPOA may request that the State representative<br />
hold a grievance conference. If the State representative agrees to hold a grievance<br />
conference and a grievance conference is scheduled, the grievant and the CCPOA<br />
representative may attend without loss of compensation.<br />
6.06 Employee Rights<br />
Each employee retains all rights conferred by Section 3512, et seq., of the Ralph C. Dills<br />
Act.<br />
6.07 Informal Discussion - Step 1<br />
A. An employee grievance initially shall be discussed with the employee's involved<br />
supervisor within twenty-one (21) calendar days of the alleged violation or after<br />
knowledge of same reasonably should have been acquired. The involved<br />
supervisor shall render an immediate response, if possible, or within seven (7)<br />
calendar days if he/she requires further research.<br />
B. If it is clear that the supervisor does not have the authority to grant the grievance,<br />
he/she must so state this fact to the grievant immediately on the appropriate<br />
worksheet. (See Appendix Item #1)<br />
C. The involved supervisor's resolution of the grievance at Step 1 shall be nonprecedential.<br />
6.08 Formal Appeal - Step 2<br />
A. If a grievance is not resolved at Step 1 to the satisfaction of the grievant, a formal<br />
grievance may be filed no later than within seven (7) calendar days of the decision<br />
at Step 1.<br />
B. However, if a CCPOA grievance is not initiated at Step 1, the grievance must be<br />
filed within twenty-one (21) calendar days after the event or circumstances<br />
occasioning the grievance, or within twenty-one (21) calendar days of the alleged<br />
violation or after knowledge of same reasonably should have been acquired.<br />
C. A formal grievance shall be initiated in writing on the mutually negotiated<br />
grievance form provided by the State, and shall be filed with the Appointing<br />
Authority or designee. Upon filing of the written grievance, the institution or<br />
parole region shall assign the grievance a number in accordance with Appendix<br />
Item #2.<br />
D. If the grievance is not in the scope of authority of the Appointing Authority or<br />
designee to grant, the grievant's CCPOA Job Steward may file the grievance<br />
directly at Step 3 of the grievance process, unless the grievance alleges a violation<br />
of an MOU section which may be appealed to "mini-arb" pursuant to Section<br />
6.13. These grievances may not be filed directly at the third level under any<br />
circumstances.
