drug designated in Subsection B.1.a.(1) through (8), or be impaired by use<br />
of alcohol while on the job.<br />
2. To maintain a workplace free from the negative effects of drug and<br />
alcohol use, the parties agree that, effective April 15, 1998, all newly hired<br />
Bargaining Unit 6 employees and newly reinstated employees with a break<br />
in service of more than twelve (12) months, as defined in Section 12.01,<br />
will be subject to unannounced random drug and alcohol testing. Newly<br />
hired means when an employee is first appointed into a Bargaining Unit 6<br />
classification.<br />
A. Random Testing Process and Standards<br />
1. The drug and alcohol testing process shall be one that is scientifically<br />
proven to be at least as accurate and valid as urinalysis using an<br />
immunoassay screening test, with all positive screening results being<br />
confirmed, utilizing gas chromatography/mass spectrometry before a<br />
sample is considered positive. The alcohol testing process shall be one that<br />
is scientifically proven to be at least as accurate and valid as (1) urinalysis<br />
using an enzymatic assay screening test, with all positive screening results<br />
being confirmed using gas chromatography before a sample is considered<br />
positive or (2) breath sample testing using an evidential breath testing<br />
device which meets the standards specified in the federal regulation 49<br />
CFR Part 40 and is an approved device on the federal conforming products<br />
list.<br />
a. Substances to be tested for shall include the following,<br />
using established procedures specified by the Substance<br />
Abuse and Mental Health Services Administration<br />
(SAMSHA):<br />
2. Marijuana/cannabinoids (THC)<br />
3. Opiates (narcotics)<br />
4. Phencyclidine (PCP)<br />
5. Barbiturates<br />
6. Benzodiazepines<br />
7. Methaqualone<br />
8. Alcohol<br />
1. Amphetamines and Methamphetamines<br />
2. Cocaine<br />
a. The State will use the test cut-off levels established in<br />
Section 9.13 C.3. for identifying positive test samples.<br />
1. Test samples will be collected in a clinical setting, such as a laboratory<br />
collection station, doctor's office, hospital or clinic, or in another setting<br />
approved by the State on the basis that it provides for at least an equally
