Federal agencies routinely generate, use, store, and share in<strong>for</strong>mation that, although does not<br />

meet the standards <strong>for</strong> Classified National Security In<strong>for</strong>mation under Executive Order<br />

13526 of December 29, 2009, is sufficiently sensitive to warrant some level of protection, in<br />

accordance with Executive Order 13556, Controlled Unclassified In<strong>for</strong>mation (CUI), signed<br />

November 4, 2010. <strong>First</strong> responders should be aware of the federal handling requirements <strong>for</strong><br />

sensitive or CUI to ensure it is used only by those who need it and only <strong>for</strong> its intended purpose.<br />

Until official implementing instructions and markings are provided by the In<strong>for</strong>mation Security<br />

Oversight Office (ISOO) to denote CUI, <strong>gov</strong>ernment agencies shall continue to use dissemination<br />

control markings such as FOR OFFICIAL USE ONLY (FOUO), LAW ENFORCEMENT SENSITIVE,<br />

SENSITIVE BUT UNCLASSIFIED, and OFFICIAL USE ONLY. In many instances the requirements<br />

<strong>for</strong> safeguarding this in<strong>for</strong>mation are equivalent; however, these current markings may change<br />

substantially once CUI markings have been developed, approved and adopted <strong>for</strong> implementation<br />

throughout the Federal Government.<br />

FOUO, per 32 CFR Section 286.15 and CUI, per Executive Order 13556, is in<strong>for</strong>mation that has<br />

not been given a security classification pursuant to Executive Order 13526-National Security<br />

In<strong>for</strong>mation, but which may be witheld from the public because disclosure would cause a<br />

<strong>for</strong>seeable harm to an interest protected by one or more Freedom Of In<strong>for</strong>mation Act (FOIA)<br />

exemptions. FOUO and CUI shall be considered as warranting protection or safeguarding.
