FOUO is not a classification, but one of the most widely used dissemination control markings. It<br />
is used typically though not consistently throughout <strong>gov</strong>ernment to identify unclassified<br />
in<strong>for</strong>mation of a sensitive nature that may or may not otherwise be categorized by statute or<br />
regulation, the unauthorized disclosure of which could adversely impact a person’s privacy or<br />
welfare, the conduct of Federal programs, or other programs or operations essential to the<br />
national or other <strong>gov</strong>ernment interests.<br />
Dissemination of FOUO is typically restricted to persons with “need-to-know”. Need-to-know is<br />
defined as “the determination made by an authorized holder of in<strong>for</strong>mation that a prospective<br />
recipient requires access in order to per<strong>for</strong>m or assist in a lawful and authorized <strong>gov</strong>ernmental<br />
function (that is, access is required <strong>for</strong> the per<strong>for</strong>mance of official duties).” Other typical FOUO<br />
requirements include:<br />
• FOUO in<strong>for</strong>mation will not be disseminated in any manner–orally, visually, or<br />
electronically–to unauthorized personnel.<br />
• The holder of the in<strong>for</strong>mation will comply with access and dissemination restrictions.<br />
• The recipient of FOUO must have valid need-to-know, and precautions are taken to<br />
prevent unauthorized individuals from overhearing the conversation, observing the<br />
materials, or otherwise obtaining the in<strong>for</strong>mation.<br />

In<strong>for</strong>mation labeled FOUO or any other control marking needs to be safeguarded and withheld<br />
from public release until such time as the originating agency clarifies the nature of<br />
the handling requirements and/or approves it <strong>for</strong> public release.
