10.2. Bu Şartnamenin 9 uncu maddesi uyarınca ihaleye katılamayacak olanlar ile 4734 sayılı
Kanunun 10 uncu maddesinin dördüncü fıkrası uyarınca ihale dışı bırakılma nedenlerinin
taşıyan istekliler değerlendirme dışı bırakılır.
10.2. Those applicants who may not participate in the tender as per article 9 of these specifications
and those sustaining the causes for exclusion from the tender pursuant to the fourth sub-paragraph
of the 10th article of Act number 4734 are excluded from evaluation.
10.3. 4734 sayılı Kanunun 11 inci maddesi uyarınca ihaleye katılamayacak olanlar ile 17 nci
maddesinde sayılan yasak fiil veya davranışta bulunduğu tespit edilenler hakkında, ayrıca, fiil
veya davranışın özelliğine göre aynı Kanunun Dördüncü kısmında belirtilen hükümler
uygulanır.
10.3. Regarding those who may not participate in the tender as per the 11th article of Act number
4734 and those determined to have engaged in the prohibited acts and actions listed in its 17 article,
the provisions stated in the Fourth part of the same Act are additionally applied depending on the
nature of the act or action.

Article 11- Tender preparation expenses
Tekliflerin hazırlanması ve sunulması ile ilgili bütün masraflar isteklilere aittir. İstekli,
teklifini hazırlamak için yapmış olduğu hiçbir masrafı İdareden isteyemez.
Tenderer shall be responsible for all of the expenses incurred in connection with preparing and
submitting bids. The Contracting Entity cannot be held responsible with regard to the expenses born
by the tenderer, regardless of the course and result of the tender.
Madde 12- İhale dokümanına ilişkin açıklama yapılması
Article 12- Explanations of the Tender Document
12.1. İstekliler, tekliflerin hazırlanması aşamasında, ihale dokümanında açıklanmasına
ihtiyaç duydukları hususlarla ilgili olarak, ihale tarihinden (20) yirmi gün öncesine kadar
yazılı olarak açıklama talep edebilirler. Bu tarihten sonra yapılacak açıklama talepleri
değerlendirmeye alınmayacaktır.
12.1. Tenderers may request written clarification of the tender document for such issues as they
judge necessary until at the latest twenty (20) days prior to the deadline for submittal of bids.
Requests made after this date shall not be considered.
12.2. Talebin uygun görülmesi halinde İdarece yapılacak yazılı açıklama, ihale tarihinden en
az 10 (on) gün öncesinde bilgi sahibi olmalarını temin edecek şekilde ihale dokümanı alanların
tamamına gönderilir veya imza karşılığı elden tebliğ edilir.
12.2. Where such a request is deemed appropriate by the Contracting Entity, the clarifications and
explanations to be made by the Contracting Entity shall be sent in writing through registered mail or
may be hand-delivered against signature, to all tenderers who have already acquired the tender
documents by that date. The written explanation of the Contracting Entity will be sent in a timely
manner so as to ensure that all tenderers will have been informed at the latest ten (10) days before
the bidding date.
12.3. Açıklamada, sorular ile İdarenin ayrıntılı cevabı yer alır, açıklama talebinde bulunanın
kimliği belirtilmez.
12.3. The explanation will contain the description of the problem and the detailed answers of the
Contracting Entity; the identity of the tenderer who has made the request shall not be disclosed.
12.4. Açıklamalar, açıklamanın yapıldığı tarihten sonra dokümanı satın alanlara ihale
dokümanının bir parçası olarak verilir.
12.4. Complementary or supplementary explanations will be included as an annex to the tender
document for those tenderers who purchase the tender document after the explanation has been
made.
