33.2. The Tender commission shall evaluate the abnormally low tenders with regard to the written clarifications by documenting; a) The cost – effectiveness of manufacturing process, b) Technical solutions selected and the advantageous conditions that shall be used by the tenderer in supplying the goods and services, c) Originality of the product offered. As a result of this evaluation, the tenders of the tenderers whose clarifications are not deemed satisfactory or that do not make any written clarification shall be rejected. 33.3. İhale komisyonu tarafından, aşırı düşük tekliflerin tespiti, değerlendirilmesi ve ekonomik açıdan en avantajlı teklifin belirlenmesinde, sınır değer veya sorgulama kriterleri ya da ortalamalara ilişkin olarak Kamu İhale Kurumu tarafından düzenleme yapılmış ise bu düzenlemelerde yer alan kriterler esas alınacaktır. 33.3 Regarding the limit value or enquiry criteria or averages inn the determination of excessively low proposals by the Tendering Commission, (their) evaluation and the establishment of the economically most advantageous proposal, even though an arrangement has been brought by the Public Procurement Authority, the criteria given in this regulation shall be taken as the basis. 35.4.1. In the event the price proposed by more than one applicants is the lowest and that such prices are equal to each other, the economically most advantageous proposal shall be determined according to the document amount in the document submitted by the applicant showing the work experience in relation with the work which is the subject matter of the tender or similar work. 35.4.2. In determining that the proposals from more than one applicant are equivalent and of the proposal which is economically most advantageous, the arrangement in article 35.4.1, and the arrangement in the 62nd article of the Implementation Regulation for Goods Purchasing Tenders shall be taken as the basis. 35.5. The evaluation of the proposals shall be conducted by converting, over the R.T. Central Bank foreign exchange buy rate or the cross rate published in the Official Gazette on the tender date, the proposed prices to the monetary unit on which the payments shall be based. Madde 36 - İhalenin karara bağlanması Article 36 – Dispose of the Awarding 36.1. Yapılan değerlendirme sonucunda ihale komisyonu tarafından ihale, ekonomik açıdan en avantajlı teklifi veren istekli üzerinde bırakılır. 36.1. The tenderer that submits the most economically advantageous offer shall be awarded the contract as a result of the Contracting Entity’s evaluation. 36.2. İhale komisyonu, yapacağı değerlendirme sonucunda gerekçeli bir karar alarak ihale yetkilisinin onayına sunar. 36.2. The Tender commission shall make its resolution with reasons thereof and submit to the contracting officer for approval. Madde 37 - İhale kararının onaylanması veya iptali Article 37 – Approval or Cancellation of the Award. 37.1. İhale kararı ihale yetkilisince onaylanmadan önce, ihale üzerinde bırakılan istekli ile varsa ekonomik açıdan en avantajlı ikinci teklif sahibi isteklinin ihalelere katılmaktan yasaklı olup olmadığı Kurumdan teyit edilerek buna ilişkin belge ihale kararına eklenir. 37.1 The Contracting entities shall check whether the tenderer who is awarded the contract is prohibited from taking part in the procurements through the Public Procurement Authority prior to approval of the contracting officer and annex the document to this effect to the procurement award. 37.2. Yapılan teyit işlemi sonucunda, her iki isteklinin de yasaklı çıkması durumunda ihale iptal edilir. 37.2.
