İhale dokümanını satın almak isteyenler, ihale dokümanını oluşturan belgelerin aslına uygunluğunu ve belgelerin tamam olup olmadığını kontrol eder. Bu incelemeden sonra, ihale dokümanını oluşturan belgelerin tamamının aslına uygun olarak teslim aldığına dair standart form biri satın alana verilmek üzere iki nüsha olarak imzalanır. 4.2. The tender document shall be provided together with a list of contents. The tenderer shall check the conformity of all the documents with their respective originals and their completeness. After this inspection, two copies of a memorandum which indicates that the tenderer has received all of the documents in line with the originals are signed. One copy of the signed memorandum is handed over to the tenderer. 4.3. Doküman satış bedelinin önceden İdare hesabına havale edilmesi kaydıyla, ihale dokümanı posta veya kargo yoluyla satın alınabilir. Dokümanın posta veya kargo yoluyla satın alınmasına ilişkin talep yazısı, doküman bedelinin İdarenin hesabına yatırıldığına ilişkin dekont ile birlikte ihale tarihinden en az beş gün önce İdareye faks veya posta yoluyla bildirilir. İdare, talebin alındığı tarihi izleyen iki iş günü <strong>için</strong>de dokümanı, doküman satın alındığına ilişkin İdare yetkilisince imzalı formu da ekleyerek, talep sahibinin belirttiği adrese gönderir. Bu durumda dokümanın postaya veya kargoya verildiği tarih, dokümanın satın alınma tarihi olarak kabul edilir. Dokümanın ulaşmamasından veya geç ulaşmasından ya da eksik olmasından dolayı İdare hiçbir şekilde sorumlu tutulamaz. 4.3. The tender documents may be purchased via courier service if the fees of the tender documents are transferred to the bank account of the contracting entity. The tenderers’ letter which requests the contracting entity to send them the tender documents via courier service and the bank slip demonstrating that the fee of the tender document has been transferred to the contracting entity’s bank account should reach the contracting entity at least five days before the tender date. The contracting entity sends the tender documents to the address which tenderer indicated in his letter in the following two days after receiving the tenderer’s request, and also encloses the signed form which demonstrates that the tender document has been purchased. The date on which the tender documents have been handed over to courier service or postal service will be considered as purchase date of the tender document. The contracting entity will not be kept liable if the tender documents don’t reach the tenderer on time or don’t reach at all. 4.4. İhale dokümanının tamamını veya bir kısmını oluşturan belgelerin, Türkçe yanında başka dillerde de hazırlanıp isteklilere verilmesi halinde, ihale dokümanının anlaşılmasında, yorumlanmasında ve anlaşmazlıkların çözümünde Türkçe metin esas alınır. 4.4. The Turkish version of the tender documents shall prevail for the settlement of disputes that may arise between the Entity and Tenderers in the interpretation and understanding of the tender document, in case the tender documents have been prepared both in Turkish and other languages and sold to tenderers.
