Those additional positive hours will be transferred to stand by call out hours and only urgent managerial business should be carried out in stand by call out periods; In accordance with the Flexible duty system arrangements, as per the Scheme of Conditions of Service Sixth Edition 2004, all managers should not carry out any request for additional duties on their rota leave days; In accordance with the Flexible duty system arrangements, as per the Scheme of Conditions of Service Sixth Edition 2004, all managers should not be driving in standby call 104 FBU Annual Report 2011
SECTION G — INTERNAL ADMINISTRATION ● ● ● out hours unless requested to attend urgent managerial business for the authority; A ban on participation in all voluntary projects, which includes the withdrawal from those projects members are currently participating in. This includes but is not limited to the following voluntary projects: Life; Junior Firesetters; Outreach; Community Fire Cadets; Prison, Me? No Way!; and the cycle project. All members who are conditioned to nine day fortnight working will take their agreed rota day each fortnight. That is the day agreed when taking up the placement except where a different day has been agreed for this year in which case it will be that different day. The industrial action short of strike was then escalated to include a ban on all temporary promotion and acting up applying to those attached to the current 9 hour/15 hour shift pattern. Affected members were to revert to their substantive roles from 0900hrs on 4 October 2010. Number of votes cast in the ballot: 4,222 Number of individuals answering “yes”: 4,014 Number of individuals answering “no”: 201 Number of spoiled voting papers: 7 Turnout: 76% Yes: 95% No: 5% London trade dispute – call for action consisting of strike Fire Brigades Union trade dispute: proposal to impose changes in terms and conditions by dismissal and re-engagement of the workforce industrial action ballot LFEPA continued to force through changes in terms and conditions of employment by maintaining the section 188 procedure prior to dismissing the workforce and re-engaging them on new imposed terms. The authority did not withdraw the section 188 notices issued and did not agree that this was an unacceptable means to force through changes in terms and conditions of employment. Neither was it accepted that any changes would be negotiated with the FBU and agreed. Instead, it was suggested that proceeding by agreement amounted to a veto over change which the authority could not give. In addition, the authority continued to pursue industrial relations on the basis of imposition and threat rather than negotiation and agreement. New contracts were written for those promoted to crew manager and watch manager from 11 August 2010 and for those joining the brigade or transferring in. Again these were not negotiated or agreed. Members faced being forced onto these contracts on promotion, transfer and recruitment respectively. Authority managers also tried to bully members legitimately wearing stickers opposing bullying and the mass dismissal of the workforce. Those members were threatened with disciplinary action for exercising their rights in the workplace. This was completely unjustified. Members cannot be expected to tolerate such threats and intimidation at work. London members required all of the following to be met by the authority: 1. Confirmation that, whether or not agreement is reached on the issue of working hours, or on any other matters where the authority wishes there to be changes in contractual terms, there will be no attempt to force through changes in terms and conditions of employment by dismissing the workforce and re-engaging them on new imposed terms. 2. Immediate withdrawal of all notices of proposed termination of contracts of employment under section 188 and confirmation that the fire authority is no longer operating the section 188 procedure. 3. Agreement that this is an unacceptable means to force through changes in terms and conditions of employment. Acceptance that any changes will be negotiated with FBU and agreed. 4. Withdrawal of the new contracts now being issued for those promoted to crew manager and watch manager since 11 August 2010 and for those joining the brigade or transferring in. Continuation of the existing contracts for such personnel until any changes have been negotiated and agreed with the FBU. 5. Immediate withdrawal of the threatened disciplinary action against members legitimately displaying their opposition to bullying and the mass dismissal of the workforce. Acceptance that those members are exercising their rights in the workplace and cannot be disciplined for doing so. The FBU maintained that until it received a formal confirmation as specifically required above in respect of all five points, a trade dispute existed between the authority and FBU members employed by the authority. This dispute plainly related to the terms and conditions of employment and working conditions. In addition, the negotiation machinery was central to this dispute.
