satisfactory to the Bank to address such practices when they occur;<br />

will sanction a firm or individual, including declaring ineligible, either indefinitely or<br />

for a stated period of time, to be awarded a Bank-financed contract if it at any time<br />

determines that the firm has, directly or through an agent, engaged in corrupt,<br />

fraudulent, collusive, coercive or obstructive practices in competing for, or in<br />

executing, a Bank-financed contract; and<br />

will have the right to require that a provision be included in bidding documents and in<br />

contracts financed by a Bank loan, requiring bidders, suppliers, and contractors and<br />

their sub-contractors to permit the Bank to inspect their accounts and records and other<br />

documents relating to the bid submission and contract performance and to have them<br />

audited by auditors appointed by the Bank.<br />

3.2. Furthermore, bidders shall be aware of the provision stated in GCC Sub-Clause 60.<br />

4. Eligible<br />

Bidders<br />

4.1. A Bidder, and all parties constituting the Bidder, may have the nationality of any country,<br />

subject to the provisions of Section III, Eligible Countries. A Bidder shall be deemed to<br />

have the nationality of a country if the Bidder is a citizen or is constituted, incorporated,<br />

or registered and operates in conformity with the provisions of the laws of that country.<br />

This criterion shall also apply to the determination of the nationality of proposed<br />

subcontractors.<br />

4.2. A Bidder shall not have a conflict of interest. All Bidders found to have conflict of interest<br />

shall be disqualified. Bidders may be considered to have a conflict of interest with one or<br />

more parties in this bidding process, if they are associated, or has been associated in the<br />

past, directly or indirectly, with the consultant or any other entity that has prepared the<br />

design, specifications, and other documents for the <strong>Project</strong> or being proposed as <strong>Project</strong><br />

Manager for the Contract. A firm that has been engaged by the Borrower to provide<br />

consulting services for the preparation or supervision of the Works, and any of its<br />

affiliates shall not be eligible to bid.<br />

4.3. A Bidder that is under a declaration of ineligibility by the Bank in accordance with ITB<br />

Clause 3, at the date of contract award, shall be disqualified. The list of such debarred<br />

firms is available at the electronic address specified in the BDS.<br />

4.4. A firm that has been determined to be ineligible by the Bank in relation to the Bank<br />

Guidelines On Preventing and Combating Fraud and Corruption in <strong>Project</strong>s Financed by<br />

IBRD Loans and IDA Credits and Grants shall be not be eligible to be awarded a contract.<br />

4.5. Government-owned enterprises in the Employer’s country may be eligible only if they can<br />

establish that they (i) are legally and financially autonomous, (ii) operate under<br />

commercial law, and (iii) that they are not a dependent agency of the Borrower or Sub-<br />

Borrower or Employer.<br />

4.6. Bidders shall provide such evidence of their continued eligibility satisfactory to the
