Section III: Rent Supplement and Rental Assistance Payment ProjectsTo implement these provisions, HUD is waiving section 8(o)(13)(D) of the Act, as well asrelated provisions of 24 CFR §§ 983.56, 983.257(c), 983.261(a) and (d) for initial occupancyin the <strong>RAD</strong> converted project. 102B. Site Selection – Compliance with PBV goals, 24 CFR §§ 983.57(b)(1) and (c). HUD iswaiving these provisions, having to do with income mixing and deconcentration of poverty.However, HUD reserves the right to assess and consider as part of the <strong>RAD</strong> request theimpact of the proposed <strong>RAD</strong> conversion on deconcentration of poverty or concentration ofassistance in properties where the <strong>RAD</strong> conversion would result in an increase in the numberof units at the property receiving project-based rental assistance.C. Owner Proposal Selection Procedures, 24 CFR § 983.51. Selections under Sections 3.6and 3.7 of this <strong>Notice</strong> shall be made in accordance with program requirements detailed in this<strong>Notice</strong> and selection requirements under § 983.51 are not applicable.Finally, for all projects that will use FHA multifamily mortgage insurance in financing related tothe conversion, HUD will perform the environmental review under 24 CFR Part 50, and noreview will be required under 24 CFR Part 58.All other regulatory and statutory requirements of the PBV program in 24 CFR Part 983 shallapply to conversions pursuant to Sections 3.6 and 3.7 of this <strong>Notice</strong>, including Family Right toMove under 24 CFR § 983.260 (i.e., choice-mobility), environmental review, and fair housingrequirements.3.6 Processing Requirements for Prospective ConversionsFor prospective conversions, the owner is required to contact the HUD field office, contact alocal PHA, and comply with all required tenant notification and briefing requirements, prior tosubmitting the <strong>RAD</strong> request to HUD.With the exception of owners of properties with Rent Supp or RAP contracts that expire afterSeptember 30, 2013, the first step for the owner is to contact the Multifamily Hub/ProgramCenter to express interest in a <strong>RAD</strong> conversion. (Owners of properties with Rent Supp or RAPcontracts that expire after September 30, 2013, need only to submit a letter of interest at thispoint in the process. See Section 3.6.3(B) below.) With this initial contact, the owner orowner’s representative will schedule a briefing for project residents, to be held by the PublicHousing field office staff and with participation from HUD Multifamily field office staff, in amanner that is feasible (e.g. in-person, teleconference, etc).102 See also 73 FR 71037, which implements language in the Housing and Economic Recovery Act, allowing for thecap on the number of PBV units to apply to a project, rather than a building.
