Section I: Public Housing ProjectsOnce the property is converted, residents not then enrolled in PH FSS will not be eligibleto participate in the program. PHAs will be allowed to use any funds already granted forPH FSS coordinator salaries until such funds are expended, at which point they are nolonger required to include the families in the FSS program. Participants in converted unitswill not be counted towards future PH FSS funding once converted.Current ROSS-SC grantees will be able to finish out their current ROSS-SC grants oncetheir housing is converted under <strong>RAD</strong>. However, once the property is converted, it willno longer be eligible to be counted towards the unit count for future public housingROSS-SC grants, nor will its residents be eligible to be served by future public housingROSS-SC grants.6. Resident Participation and Funding. In accordance with Attachment 1B, residents ofcovered projects converting assistance to PBVs will have the right to establish andoperate a resident organization for the purpose of addressing issues related to their livingenvironment and be eligible for resident participation funding.7. Resident Procedural Rights.a. Termination Notification. HUD is incorporating additional termination notificationrequirements to comply with section 6 of the Act for public housing projects thatconvert assistance under <strong>RAD</strong>. In addition to the regulations at 24 CFR § 983.257,related to owner termination of tenancy and eviction, as modified by the waiver inSection 1.6(C)(3) above, the termination procedure for <strong>RAD</strong> conversions to PBV willrequire that PHAs provide adequate written notice of termination of the lease whichshall not be less than:i. A reasonable period of time, but not to exceed 30 days:If the health or safety of other tenants, PHA employees, or personsresiding in the immediate vicinity of the premises is threatened; orIn the event of any drug-related or violent criminal activity or any felonyconviction;ii.iii.14 days in the case of nonpayment of rent; and30 days in any other case, except that if a State or local law provides for ashorter period of time, such shorter period shall apply.b. Grievance Process. HUD is incorporating additional procedural rights to complywith the requirements of section 6 of the Act.For issues related to tenancy and termination of assistance, PBV program rulesrequire the PHA to provide an opportunity for an informal hearing, as outlined in 24<strong>PIH</strong>-<strong>2012</strong>-<strong>32</strong> (HA) Rental Assistance Demonstration – Final Implementation 33
