Section III: Rent Supplement and Rental Assistance Payment Projects3.6.2 HUD Review of <strong>RAD</strong> RequestHUD will review the owner's request to verify that the conditions of this <strong>Notice</strong> are met.Specifically, the review will verify the following:The owner has correctly identified the number of units proposed for conversion and to beincluded in the PBV HAP contract to be executed by the PHA and the owner (the finalnumber is subject to family program eligibility and income verification by the PHA).This includes verifying the owner has correctly determined if EVs triggered by aprepayment are eligible to convert under the PBV HAP contract following therequirements of Section 3.4(C), ―Eligible Units‖;The owner has complied with the resident notice and briefing requirements in this<strong>Notice</strong>, and satisfactorily addressed resident comments;The project and owner meet all eligibility requirements listed in Section 3.4 of this<strong>Notice</strong>; andThe owner has satisfactorily addressed residents’ comments. HUD will carefully reviewresidents’ comments and owner response to the comments. If more than 50 percent ofwritten resident comments disapprove of the conversion of assistance, HUD mustcontact the owner to discuss options for proceeding with the conversion request.HUD reserves the right to deny the conversion request if the conditions of this <strong>Notice</strong> arenot met, or if the owner does not satisfactorily address concerns raised in residents’comments.HUD will also verify the correct rent setting for the PBV contract units, which may beup to 110% of FMR subject to rent reasonableness as determined by the PHA. HUDHeadquarters will notify the PHA if any special rent setting provisions apply to theproject, for example, for LIHPRHA (Title VI) projects.3.6.3 Allocation of TPV Resources for ConversionsA. Contract Expirations on or before September 30, 2013. For all prospective requests thatinvolve a Rent Supp or RAP contract with an expiration date on or before September 30,2013, HUD will: review submissions according to the instructions in Section 3.6.2, above;make a determination of whether tenant protection funding is available; and within 45 daysof receipt of request notify the owner of the determination, and, if accepted, forward the<strong>RAD</strong> project request to the HUD Public Housing Field Office Director to identify an eligiblePHA to administer the PBV contract (as described in Section 3.6.4), who would requestfunding (as described in Section 3.6.5).<strong>PIH</strong>-<strong>2012</strong>-<strong>32</strong> (HA) Rental Assistance Demonstration – Final Implementation 135
