For all other projects, the environmental review will be completed by a state or unit ofgeneral local government (Responsible Entity) under 24 CFR Part 58, or by HUDunder 24 CFR Part 50 if a PHA objects to the RE or the RE objects to performing thereview.Note: While many projects will be categorically excluded from review under the <strong>National</strong>Environmental Policy Act because they do not involve major rehabilitation, they remainsubject to review under related environmental laws and authorities. The environmentalreview may result in rejection of the site for this demonstration, or may result in arejection of the application for multifamily mortgage insurance. Consequently, acompleted environmental review (including a HUD approval of a Release of Funds,where required under Part 58) will be required as part of the Financing Plan. Theenvironmental review may require carrying out mitigation measures. Any requiredenvironmental conditions will be included in the RCC and the HAP contract.E. Relocation Plan. The PHA must include a relocation plan for the rehabilitation or newconstruction, including a relocation budget and a certification that the relocation plancomplies with all applicable HUD requirements, including the Uniform RelocationAssistance and Real Property Acquisition Policies Act of 1970 (URA) and its implementingregulations (49 CFR Part 24). 60 The cost of the relocation must be fully funded in theDevelopment Budget.F. Development Budget (Sources and Uses of Funds). The Development Budget must:1. Include a reasonable, balanced and comprehensive presentation of sources and uses offunds, prepared using a HUD-prescribed template and which is in accordance with allapplicable HUD requirements.2. Demonstrate that existing loans or debt will be paid off at the closing or supportedthrough NOI.3. Demonstrate that any Identity of Interest (IOI) loans or advances will be converted tounsecured Surplus Cash Notes (IOI loans may not be paid off from the proceeds of newfinancing).4. Include narrative that discusses any aspects of the planned rehabilitation that may resultin an initial operating deficit during the rehabilitation and how that deficit will befunded, including any operating deficit escrow or similar fund.60 For a step by step process to comply with the URA, follow the steps in Exhibit 3-1 in the HUD RelocationHandbook 1378 CHG-9.
