Appendix F. N. L. R. B. Rules and Regulations 223the Board or the Regional Director approves the withdrawal of anypetition the case shall be closed. Except as provided in Section 11of this Article, such petition shall be filed with the Regional Directorfor the Region wherein the contemplated bargaining unit exists, or, ifthe contemplated bargaining unit exists in two or more Regions, withthe Regional Director for any of such Regions. Such petition shall bein writing, the original being signed and sworn to before any notarypublic or other person duly authorized by law to administer oathsand take acknowledgments or any agent of the Board authorized toadminister oaths or acknowledgments. Three copies of the petitionshall be filed.'SEC. 2. Same; contents.—(a) Such petition, when filed by anemployee or any person or labor organization acting on behalf ofemployees, shall contain the following:(1) The name and address of the petitioner.(2) The name and address of the employer or employers involvedand the general nature of their business.(3) A brief statement setting forth the nature of the questionaffecting commerce that has arisen concerning the representationof employees.(4) Any other relevant facts.(b) Such petition, when filed by an employer shall contain thefollowing:(1) The name and address of the petitioner.(2) The general nature of petitioner's business.(3) A brief statment setting forth that a question or controversyaffecting commerce has arisen concerning the representationof employees in that two or more labor organizations have presentedto the employer conflicting claims that each representsa majority of the employees in the unit or units claimed to beappropriate.(4) Any other relevant facts.SEC. 3. Same; investigation by Regional Director; definition ofparties; Notice of Hearing; service of notice; withdrawal of notice.—After a petition has been filed, if it appears to the Regional Directorthat an investigation should be instituted he shall institute such'Blank forms for filing such petitions will be supplied by the Regional Director upon request.
224 Eighth Annual Report of the National Labor Relations Boardinvestigation by issuing a Notice of Hearing, provided that theRegional Director shall not institute an investigation on a petitionfiled by an employer unless it appears to the Regional Director thattwo or more labor organizations have presented to the employer conflictingclaims that each represents a majority of the employees in thebargaining unit or units claimed to be appropriate. The RegionalDirector shall prepare and cause to be served upon the petitionersand upon the employer or employers involved (all of whom are hereinafterreferred to as "the parties"), and upon any known individuals orlabor organizations purporting to act as representatives of any employeesdirectly affected by such investigation, a Notice of Hearingupon the question ef representation before a Trial Examiner at a timeand place fixed therein, provided that when the petition is filed by anemployer the Regional Director shall serve the Notice of Hearing onthe employer petitioner and on the labor organizations named in thepetition (all of whom are hereinafter referred to as "the parties"),and upon any known individuals or labor organizations purporting toact as representatives of any employees directly affected by-suchinvestigation. A copy of the petition shall be served with suchNotice of Hearing. Any such Notice of Hearing may be withdrawnbefore the hearing by the Regional Director on his own motion.SEC. 4. Appeals to Board by petitioner from action of Regional Director.—If,after a petition has been filed, the Regional Director declinesto institute an investigation, the employee, person, labor organization,or employer filing the petition may obtain a review of such action byfiling a request therefor with the Board in Washington, D. C., andfiling a copy of such request with the Regional Director. This requestshall contain a complete statement setting forth the facts and reasonsupon which the request is based.SEC. 5. Same; motions; interventions; witnesses; sapenas.—All mattersrelating to motions, intervention, witnesses, and subpenas shallbe governed by the provisions of Sections 14 to 22 of Article II,inclusive, of these Rules and Regulations insofar as applicable, exceptthat the references to "the Regional Director issuing the complaint"shall for the purposes of this Article, mean the Regional Directorissuing the Notice of Hearing, and references to the "complaint" shallfor the purposes of this Article mean the petition. Motions to dismisspetitions if made prior to the hearing, shall be filed with the RegionalDirector, and if made during the hearing, with the Trial Examiner,and shall be referred to the Board for appropriate action.
