Rules and Regulations 233thereof, whether in the Regional Offices of the <strong>Board</strong> or in its principaloffice in the District of Columbia, are in the exclusive control andcustody of the <strong>Board</strong> for the purpose of administering and effectuatingthe policies of the Act; and are confidential and not subject to inspectionor examination except that the formal documents described asthe record in the case or proceeding and defined in Article II, Section32; and Article III, Sections 8 and 10 of these Rules and Regulations,shall be open to inspection and examination during usual businesshours, within the appropriate office of the <strong>Board</strong>, and true and correctcopies thereof will be certified upon submission of such copies areasonable time in advance of need.SEC. 2. Same; <strong>Board</strong> employees prohibited from producing files,records, etc., pursuant to subpena duces tecum, prohibited from testifyingin regard thereto.—No Regional Director, Examiner, Trial Examiner,attorney, specially designated agent, member of the <strong>Board</strong>, or otherofficer or employee of the <strong>Board</strong> shall produce or present any files,documents, reports, memoranda, or records of the <strong>Board</strong> . or testifyin behalf of any party to any cause pending in any court or before any<strong>Board</strong>, Commission, or other administrative agency of the UnitedStates or of any State, Territory, or the District of Columbia withrespect to any information, facts, or other matter coming to his knowledgein his official capacity or with respect to the contents of anyfiles, documents, reports, memoranda, or records of the <strong>Board</strong>, whetherin answer to a subpena, subpena duces tecum or otherwise withoutthe written consent of the <strong>Board</strong> or the Chairman of the <strong>Board</strong>.Whenever any subpena or subpena duces tecum calling for records ortestimony as described hereinabove shall have been served upon anysuch persons or other officer or employee of the <strong>Board</strong>, he will, unlessotherwise expressly directed by the <strong>Board</strong> or the Chairman of the<strong>Board</strong>, appear in answer thereto and respectfully decline by reason ofthis Rule to produce or present such files, documents, reports, memorandaor records of the <strong>Board</strong> or give such testimony.ARTICLE VIIIPRACTICE BEFORE THE BOARD OF FORMER EMPLOYEESSECTION 1. Prohibition of practice before <strong>Board</strong> of its former Regionalemployees in cases pending in Region during employment.—No personwho has been an employee of the <strong>Board</strong> and attached to any of itsRegional Offices shall engage in practice before the <strong>Board</strong> or its agents
