He helped lead the Church <strong>in</strong>to amore open <strong>in</strong>stitution with girl altar servers, morelaity <strong>in</strong>volvement <strong>in</strong>clud<strong>in</strong>g women lectors, and m<strong>in</strong>istriesto help gay <strong>Catholic</strong>s, among other measures....”One week after the Boston Globe ran Gormley’sdefense of Hubbard, the newspaper which stillenjoys tak<strong>in</strong>g credit for expos<strong>in</strong>g corruption <strong>in</strong> theChurch hierarchy, ran another defense of Hubbard by<strong>Albany</strong> freelance writer and journalism professorDarryl McGrath, a frequent reporter on “women’sreproductive health issues” for the Internet site,Women’s Enews, the news service of the NationalOrganization of Women, and Metroland, an“alternative” newspaper <strong>in</strong> <strong>Albany</strong>.McGrath’s favorable report on Hubbard wasalso featured on the Internet gay news blog(gay_blog.blogspot.com)McGrath opened her report: “When BishopHoward Hubbard of the <strong>Roman</strong> <strong>Catholic</strong> Diocese of<strong>Albany</strong> takes center stage at a news conference, it isusually to speak out on the death penalty, poverty, orsome other issue of social justice,” but now, she adds,he is “repeatedly” deny<strong>in</strong>g that “he has ever had anysexual relationship.”She offers a brief review of recent events,and then provides this gross mischaracterization ofher hometown as a “city of 90,000 people, largelyconservative and heavily <strong>Roman</strong> <strong>Catholic</strong>,” and adds,“Hubbard is respected for his ecumenical skills, hissocial activism, and his concern for the poor.“He's lived what he's preached,” said MichaelBurgess, who started a campaign of purple lapelribbons at his <strong>Albany</strong> parish to show support for Hubbard.‘He's the sa<strong>in</strong>tliest man I've ever met <strong>in</strong> the wayhe's lived his life.’”McGrath also quotes from a recent editorialby <strong>Albany</strong> Times Union editor Harry Rosenfeld, whodeplored the attacks on his good friend the bishop,argu<strong>in</strong>g, “a fair-m<strong>in</strong>ded public would demonstratesolidarity with the bishop. He needs the support ofpeople who recognize the depth of the unfairness ofhis situation.”She also brought <strong>in</strong> moral support fromDavid Kaczynski, executive director of New YorkersAga<strong>in</strong>st the Death Penalty, who “has worked closelywith Hubbard -- who serves as president of thegroup's board” – and brother of the “Unabomber.”“He's an extraord<strong>in</strong>arily strong person,” Kaczynskitold McGrath. “I th<strong>in</strong>k the th<strong>in</strong>g that has carriedthis place through is the bishop's clear and consistentstatements that he is completely <strong>in</strong>nocent. It'shard to imag<strong>in</strong>e someone hav<strong>in</strong>g the arrogance todeny these th<strong>in</strong>gs if they were true.”<strong>The</strong> Globe’s decision to publish McGrath’spuff-piece on Hubbard, speculated C. Joseph Doyle,executive director of the Massachusetts <strong>Catholic</strong> ActionLeague, “is part of an on-go<strong>in</strong>g, massive coverup<strong>in</strong> the form of an expose”.“<strong>The</strong> Globe,” he added, “has never used theword ‘homosexual’ <strong>in</strong> any of its reports on clericalsexual misconduct and crimes. It always uses‘pedophile’ or ‘ephebophile’, but won’t dare use the‘h-word’ for fear of offend<strong>in</strong>g a very powerful constituencyand push<strong>in</strong>g an agenda.”UPDATE ON THE INVESTIGATIONOn March 9, the Troy Record reported that<strong>in</strong>vestigators hired by former federal prosecutor MaryJo White <strong>in</strong>timidated an elderly woman who was aclose friend of the late Fr. John M<strong>in</strong>kler, the <strong>Albany</strong>priest who mysteriously died after he was coerced tosign<strong>in</strong>g an affidavit deny<strong>in</strong>g he wrote a report onclerical homosexuality <strong>in</strong> the diocese for the late JohnCard<strong>in</strong>al O’Connor.<strong>The</strong> Record declared:“Investigators hired by the <strong>Albany</strong> DiocesanReview Board to look <strong>in</strong>to allegations of sexual misconductaga<strong>in</strong>st Bishop Howard Hubbard refused to<strong>in</strong>terview an elderly person who may have shed lighton the death of Rev. John M<strong>in</strong>kler.“<strong>The</strong> <strong>in</strong>terview was supposed to occur <strong>in</strong>M<strong>in</strong>kler's 11th-floor office at the Stratton VeteransAffairs Hospital <strong>in</strong> <strong>Albany</strong>, but private <strong>in</strong>vestigatorsrepresent<strong>in</strong>g Mary Jo White walked away from thetable after realiz<strong>in</strong>g the elderly person wanted attor-14

Sennen SanFratello, a priestat the Veterans Affairs Hospital, argu<strong>in</strong>g with Aretakisover the legal ramifications of the attorney be<strong>in</strong>g<strong>in</strong> the room.“Citera called Aretakis' presence <strong>in</strong> theroom ‘<strong>in</strong>appropriate’ and a ‘conflict of <strong>in</strong>terest,’ consider<strong>in</strong>gthe lawyer has represented dozens of clientsalleg<strong>in</strong>g sexual abuse aga<strong>in</strong>st the diocese.“However, the <strong>in</strong>vestigator never presentedany legal reason as to why Aretakis should be barredfrom the <strong>in</strong>terview....”In an <strong>in</strong>terview with <strong>The</strong> Wanderer, Aretakissaid White’s <strong>in</strong>vestigators attempted to deprive hisclient of her constitutional rights to have an attorneypresent dur<strong>in</strong>g an <strong>in</strong>vestigation; but more importantly,Aretakis told <strong>The</strong> Wanderer, attorney Mary Jo Whiteis <strong>in</strong>capable of <strong>in</strong>vestigat<strong>in</strong>g either Fr. M<strong>in</strong>kler’sdeath or allegations that Hubbard is a homosexualpredator because she has a clear “conflict of <strong>in</strong>terest”<strong>in</strong> do<strong>in</strong>g either.As Aretakis expla<strong>in</strong>ed <strong>in</strong> a letter to White,after the March 2 <strong>in</strong>cident <strong>in</strong>volv<strong>in</strong>g his client:“.....I came <strong>in</strong>to this process with an openm<strong>in</strong>d about clients of m<strong>in</strong>e and me cooperat<strong>in</strong>g withyou but your agents’ unprofessional and bully<strong>in</strong>g tacticstoward a client of m<strong>in</strong>e who voluntarily cameforward to answer questions at the VA Hospital <strong>in</strong> Fr.M<strong>in</strong>kler’s office on March 2, 2004 revealed that youand your agents are engag<strong>in</strong>g <strong>in</strong> <strong>in</strong>timidat<strong>in</strong>g and bully<strong>in</strong>gtactics similar to that evidently experienced byFr. M<strong>in</strong>kler at the hands of Fr. [Kenneth] Doyle andBishop Hubbard on at least February 12, 2004through February 14, 2004....“I need not rem<strong>in</strong>d you that you are not ajudge, and you are no longer a government prosecutor;therefore, you nor any of your agents, nor yourpr<strong>in</strong>cipal, Bishop Hubbard, or the <strong>Albany</strong> Diocese’sSexual Misconduct Panel that is appo<strong>in</strong>ted and selectedby Bishop Hubbard or any of your otheragents, will determ<strong>in</strong>e when my presence is appropriateand when, how and to what extent a civilian decidesto reta<strong>in</strong> a lawyer of her own choos<strong>in</strong>g to repre-sent her. Whatever position you are attempt<strong>in</strong>g to setforth, you are <strong>in</strong> error, and fail to understand the adversarialnature of the relationship that your agentshave created.“In your capacity it appears you will be adjudg<strong>in</strong>g<strong>in</strong>dividual witnesses’ credibility based ontheir direct statements to you. S<strong>in</strong>ce you are not ajudge, arbitrator or approved mediator, then you mayhave become a witness <strong>in</strong> a matter <strong>in</strong> which you are<strong>in</strong>vestigat<strong>in</strong>g, and that may render you an <strong>in</strong>appropriateperson to <strong>in</strong>vestigate.“For example, on the [Anthony] Bonneaumatter, it is conceivable that the ultimate truth of theallegations may h<strong>in</strong>ge on the credibility of Mr. Bonneauversus Bishop Hubbard. Be<strong>in</strong>g paid $770 perhour by a diocese led by Bishop Hubbard renders you<strong>in</strong>capable of mak<strong>in</strong>g any such determ<strong>in</strong>ation on one<strong>in</strong>dividual’s credibility over another <strong>in</strong>dividual who isresponsible for pay<strong>in</strong>g your fee. It would be quiteeasy for you to f<strong>in</strong>d as more credible a nationallywell-known bishop of twenty seven years who is pay<strong>in</strong>gyour hourly rate over a former teenage youth whohad to engage <strong>in</strong> very regrettable actions <strong>in</strong> order tosurvive on the streets.“I believe you may also become a witness asI am aware that other witnesses have sat down withyou and credibly advised you that Bishop Hubbardhas had a life that is contradictory to his public statementsconcern<strong>in</strong>g his sexual activity and that BishopHubbard has been <strong>in</strong> violation of his vows of celibacyand chastity. Witnesses that I am aware of have advisedyou that Bishop Hubbard has been sexually active,and has protected and cont<strong>in</strong>ues to protect numerouspredatory and sexually active priests <strong>in</strong> the<strong>Albany</strong> Diocese. Will you allege that I may become awitness because I am aware of dozens and dozens ofpriests that Bishop Hubbard is still protect<strong>in</strong>g? Doyou believe I may become a witness because I havemany other <strong>in</strong>vestigations under way regard<strong>in</strong>g othersexual <strong>in</strong>discretions of Bishop Hubbard? Do you expectme to turn these matters that have not yet becomepublic over to you to <strong>in</strong>vestigate?“<strong>The</strong> reason I have not become a witness isbecause no case, civil or crim<strong>in</strong>al, is pend<strong>in</strong>g, ands<strong>in</strong>ce you are not a judge you cannot make a determ<strong>in</strong>ationon these po<strong>in</strong>ts <strong>in</strong> any event. You also can notand will not determ<strong>in</strong>e for my clients or me when it isappropriate for me to represent someone.“S<strong>in</strong>ce you will be issu<strong>in</strong>g a report, and <strong>in</strong>the report you may f<strong>in</strong>d one person more crediblethan another, and taken <strong>in</strong>to consideration that you15
