(2)(a) No <strong>na</strong>tio<strong>na</strong>l Office shall allow access to the inter<strong>na</strong>tio<strong>na</strong>l application by third parties,unless requested or authorized by the applicant, before the earliest of the following dates:(i) date of the inter<strong>na</strong>tio<strong>na</strong>l publication of the inter<strong>na</strong>tio<strong>na</strong>l application,(ii) date of the receipt of the communication of the inter<strong>na</strong>tio<strong>na</strong>l application under Article 20,(iii) date of the receipt of a copy of the inter<strong>na</strong>tio<strong>na</strong>l application under Article 22.(b) The provisions of subparagraph (a) shall not prevent any <strong>na</strong>tio<strong>na</strong>l Office from informingthird parties that it has been desig<strong>na</strong>ted, or from publishing that fact. Such information orpublication may, however, contain only the following data: identification of the receivingOffice, <strong>na</strong>me of the applicant, inter<strong>na</strong>tio<strong>na</strong>l filing date, inter<strong>na</strong>tio<strong>na</strong>l application number, andtitle of the invention.(c) The provisions of subparagraph (a) shall not prevent any desig<strong>na</strong>ted Office from allowingaccess to the inter<strong>na</strong>tio<strong>na</strong>l application for the purposes of the judicial authorities.(3) The provisions of paragraph (2) (a) shall apply to any receiving Office except as far astransmittals provided for under Article 12 (1) are concerned.(4) For the purposes of this Article, the term »access« covers any means by which thirdparties may acquire cogni<strong>za</strong>nce, including individual communication and general publication,provided, however, that no <strong>na</strong>tio<strong>na</strong>l Office shall generally publish an inter<strong>na</strong>tio<strong>na</strong>l applicationor its translation before the inter<strong>na</strong>tio<strong>na</strong>l publication or, if inter<strong>na</strong>tio<strong>na</strong>l publication has nottaken place by the expiration of 20 months from the priority date, before the expiration of 20months from the said priority date.CHAPTER IIInter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Exami<strong>na</strong>tionArticle 31Demand for Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Exami<strong>na</strong>tion(1) On the demand of the applicant, his inter<strong>na</strong>tio<strong>na</strong>l application shall be the subject of aninter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion as provided in the following provisions and theRegulations.(2)(a) Any applicant who is a resident or <strong>na</strong>tio<strong>na</strong>l, as defined in the Regulations, of aContracting State bound by Chapter II, and whose inter<strong>na</strong>tio<strong>na</strong>l application has been filedwith the receiving Office of or acting for such State, may make a demand for inter<strong>na</strong>tio<strong>na</strong>lprelimi<strong>na</strong>ry exami<strong>na</strong>tion.(b) The Assembly may decide to allow persons entitled to file inter<strong>na</strong>tio<strong>na</strong>l applications tomake a demand for inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion even if they are residents or<strong>na</strong>tio<strong>na</strong>ls of a State not party to this Treaty or not bound by Chapter II.57
