(3) The demand for inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion shall be made separately from theinter<strong>na</strong>tio<strong>na</strong>l application. The demand shall contain the prescribed particulars and shall be inthe prescribed language and form.(4)(a) The demand shall indicate the Contracting State or States in which the applicant intendsto use the results of the inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion (»elected States«). Additio<strong>na</strong>lContracting States may be elected later. Election may relate only to Contracting States alreadydesig<strong>na</strong>ted under Article 4.(b) Applicants referred to in paragraph (2) (a) may elect any Contracting State bound byChapter II. Applicants referred to in paragraph (2) (b) may elect only such Contracting Statesbound by Chapter II as have declared that they are prepared to be elected by such applicants.(5) The demand shall be subject to the payment of the prescribed fees within the prescribedtime limit.(6)(a) The demand shall be submitted to the competent Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry ExaminingAuthority referred to in Article 32.(b) Any later election shall be submitted to the Inter<strong>na</strong>tio<strong>na</strong>l Bureau.(7) Each elected Office shall be notified of its election.Article 32The Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Examining Authority(1) Inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion shall be carried out by the Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ryExamining Authority.(2) In the case of demands referred to in Article 31(2)(a), the receiving Office, and, in the caseof demands referred to in Article 31(2)(b), the Assembly, shall, in accordance with theapplicable agreement between the interested Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Examining Authorityor Authorities and the Inter<strong>na</strong>tio<strong>na</strong>l Bureau, specify the Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry ExaminingAuthority or Authorities competent for the prelimi<strong>na</strong>ry exami<strong>na</strong>tion.(3) The provisions of Article 16(3) shall apply, mutatis mutandis, in respect of Inter<strong>na</strong>tio<strong>na</strong>lPrelimi<strong>na</strong>ry Examining Authorities.Article 33The Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Exami<strong>na</strong>tion(1) The objective of the inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion is to formulate a prelimi<strong>na</strong>ryand non-binding opinion on the questions whether the claimed invention appears to be novel,to involve an inventive step (to be non-obvious), and to be industrially applicable.(2) For the purposes of the inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion, a claimed invention shall beconsidered novel if it is not anticipated by the prior art as defined in the Regulations.58
