(b) The <strong>na</strong>tio<strong>na</strong>l law of any elected State may provide that where the applicant chooses torestrict the claims under subparagraph (a), those parts of the inter<strong>na</strong>tio<strong>na</strong>l application which,as a consequence of the restriction, are not to be the subject of inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ryexami<strong>na</strong>tion shall, as far as effects in that State are concerned, be considered withdrawnunless a special fee is paid by the applicant to the <strong>na</strong>tio<strong>na</strong>l Office of that State.(c) If the applicant does not comply with the invitation referres to in subparagraph (a) withinthe prescribed time limit, the Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Examining Authority shall establish aninter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion report on those parts of the inter<strong>na</strong>tio<strong>na</strong>l applicationwhich relate to what appears to be the main invention and shall indicate the relevant facts inthe said report. The <strong>na</strong>tio<strong>na</strong>l law of any elected State may provide that, where its <strong>na</strong>tio<strong>na</strong>lOffice finds the invitation of the Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Examining Authority justified,those parts of the inter<strong>na</strong>tio<strong>na</strong>l application which do not relate to the main invention shall, asfar as effects in that State are concerned, be considered withdrawn unless a special fee is paidby the applicant to that Office.(4)(a) If the Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Examining Authority considers(i) that the inter<strong>na</strong>tio<strong>na</strong>l application relates to a subject matter on which the Inter<strong>na</strong>tio<strong>na</strong>lPrelimi<strong>na</strong>ry Examining Authority is not required, under the Regulations, carry out aninter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion and in the particular case decides not to carry out suchexami<strong>na</strong>tion, or(ii) that the description, the claims, or the drawings, are so unclear, or the claims are soi<strong>na</strong>dequately supported by the description, that no meaningful opinion can be formed on thenovelty, inventive step (non-obviousness), or industrial applicability, of the claimedinvention,the said Authority shall not go into the questions referred to in Article 33(1) and shall informthe applicant of this opinion and the reasons therefor.(b) If any of the situations referred to in subparagraph (a) is found to exist in, or in connectionwith, certain claims only, the provisions of that subparagraph shall apply only to the saidclaims.Article 35The Inter<strong>na</strong>tio<strong>na</strong>l Prelimi<strong>na</strong>ry Exami<strong>na</strong>tion Report(1) The inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion report shall be established within the prescribedtime limit and in the prescribed form.(2) The inter<strong>na</strong>tio<strong>na</strong>l prelimi<strong>na</strong>ry exami<strong>na</strong>tion report shall not contain any statement on thequestion whether the claimed invention is or seems to be patentable or unpatentable accordingto any <strong>na</strong>tio<strong>na</strong>l law. It shall state, subject to the provisions of paragraph (3), in relation to eachclaim, whether the claim appears to satisfy the criteria of novelty, inventive step (nonobviousness),and industrial applicability, as defined for the purposes of the inter<strong>na</strong>tio<strong>na</strong>lprelimi<strong>na</strong>ry exami<strong>na</strong>tion in Article 33(1) to (4). The statement shall be accompanied by thecitation of the documents believed to support the stated conclusion with such expla<strong>na</strong>tions as60
