Appendices5.4 Where a pay band is changed to a lesser amount,junior doctors will have their pay protected as perAppendix Two.6.0 Responsibility Of The Medical PersonnelDepartmentIt’s the responsibility of the medical personneldepartment:• To examine, advise and provide solutions on juniordoctor rotas• To facilitate monitoring studies <strong>for</strong> each juniordoctor rota• To summarise and analyse studies in accordancewith NHS Executive guidelines• To compare results of monitoring with New Dealand WTD criteria and highlight areas of noncompliance• To facilitate the pay banding process. Decisionsshould be made on the basis of valid and accuratemonitoring studies• To ensure that senior and junior doctors, managersand nursing staff are educated and aware of theNew Deal.8.0 Responsibility Of The Junior DoctorIt is the responsibility of the junior doctor to:• Record data on hours worked when asked to doso by the trust as set out in the terms andconditions of service• Forward recorded data to the medical personneldepartment promptly <strong>for</strong> analysis and evaluation• Work with the trust to identify appropriateworking arrangements or other organisationalchanges in working practice, when changes to arota are deemed to be necessary• Comply with changes to working practice whenimplemented• Be proactive about taking rest and natural breaksas set out in the New Deal and WTD• Make the trust aware if they work hours that aredifferent than those set out in the rota.9.0 WTD And Compensatory Rest7.0 Responsibility Of The Division7.1 It’s the responsibility the division to ensure thatevery junior doctor participates in the workintensity studies as set out in terms and conditionsof service. Sanctions in the event of failure tomonitor are set out at Appendix Three.9.1 The WTD stipulates that 11 hours continuous restshould be achieved as a minimum period off dutybetween duty periods. Where 11 hours continuousrest is not achieved, junior doctors will beexpected to take compensatory rest in unpaid timeas soon as their duty is complete.7.2 Clinical Directors and Directorate Managers willwork with the doctors participating on the juniordoctor rota to address any difficulties, exploringalternative arrangements and working patternswith the aim of finding solutions in order to ensurethat rotas comply with the New Deal and WTD.7.2 The Medical Personnel Manager will provideassistance where needed, offering support andadvice to divisions.53
