ii. Impose appropriate discipline on each <strong>of</strong>ficer against whom a complaint issustained as soon as possible after the OMI disposition.iii. Where appropriate, remedial training, counseling, transfer, or reassignment shallbe required <strong>of</strong> each <strong>of</strong>ficer where a complaint is disposed <strong>of</strong> by a disposition otherthan sustained.e. <strong>Annual</strong> performance evaluations: The PBP shall require annual performance evaluations<strong>of</strong> all <strong>of</strong>ficers, supervisors, and senior supervisors. The performance evaluation shall bein writing and shall fully explain the weight and substance <strong>of</strong> all factors used to evaluatean <strong>of</strong>ficer (Consent Decree paragraphs 23 and 24). At a minimum:i. Supervisors and senior supervisors shall be evaluated on their ability to monitor,deter, and appropriately address misconduct by <strong>of</strong>ficers they supervise; andii. The PBP shall evaluate each <strong>of</strong>ficer on the basis <strong>of</strong> his or her complaint history,focusing on patterns <strong>of</strong> misconduct.iii. In addition to the Civil Service guidelines, the performance evaluations shall beconsidered as one <strong>of</strong> the factors in making promotions.f. Employee Assistance Program: The <strong>City</strong> shall continue to provide an employeeassistance program ("EAP") (Consent Decree paragraph 25). This program shall at aminimum provide counseling and stress management services to <strong>of</strong>ficers. This programshall be staffed by sufficient licensed and certified counselors who are trained andexperienced in addressing psychological and emotional problems common to police<strong>of</strong>ficers. The <strong>City</strong> shall publicize the availability <strong>of</strong> these services to all <strong>of</strong>ficers. The<strong>City</strong> shall authorize <strong>of</strong>ficers to attend counseling without any adverse actions takenagainst them. The <strong>City</strong> shall refer <strong>of</strong>ficers to, but not require their participation in, EAPcounseling where the <strong>City</strong> believes an <strong>of</strong>ficer's job performance may benefit from EAPservices. These provisions are separate from any counseling the <strong>City</strong> may require as part<strong>of</strong> its "Track III" mandatory counseling program.g. Notice <strong>of</strong> Criminal/Civil Action: The <strong>City</strong> shall require all <strong>of</strong>ficers to notify the <strong>City</strong>when the <strong>of</strong>ficers have been arrested, criminally charged, or named as a party in any civilsuit involving allegations <strong>of</strong> untruthfulness, physical force, racial bias, or domesticviolence. The <strong>City</strong> and PBP management shall monitor all such civil litigation and allcriminal prosecutions <strong>of</strong> <strong>of</strong>ficers. PBP shall discipline and appropriately re-train,counsel, re-assign, or transfer <strong>of</strong>ficers found guilty or liable by a court or jury (ConsentDecree paragraph 26). Officers determined by a court to have falsely arrested anindividual or conducted an improper search or seizure shall be disciplined, retrained,counseled, transferred, or reassigned, as the circumstances warrant. Such litigation andinvestigations shall be reflected in (PARS) and recorded in the <strong>of</strong>ficer's complaint history(Consent Decree paragraph 27). PBP shall continue to discipline, re-train, counsel,transfer, or reassign <strong>of</strong>ficers who are the subject <strong>of</strong> civil litigation settled by the <strong>City</strong> priorto adjudication, as the circumstances and OMI investigation warrant (Consent Decreeparagraph 28).Community Relations: The United States recognizes that PBP <strong>of</strong>ficer representatives attend meetings<strong>of</strong> community groups within their zone. The PBP shall continue to make every effort to participate inthese meetings, including meetings organized by or oriented towards minorities.11
