ACADEMIC LIFEATTENDANCEStudents are expected to attend all scheduled class sessions. Students who are excessively absent or tardyfor class will have their grades lowered, may be placed on probation, or may be dismissed.Students who must be absent are encouraged to notify the professor prior to their absence and makearrangements for a classmate to obtain information covered during that class.COPYRIGHT USAGECopyright infringement is the act of exercising, without permission or legal authority, one or more of theexclusive rights granted to the copyright owner under section 106 of the Copyright Act (Title 17 of theUnited States Code), including uploading and downloading of copyrighted works via peer-to-peer (P2P)file sharing. Copyright law covers the right to reproduce or distribute a copyrighted work. BecauseFederal law prohibits the duplication of copyrighted materials, students may not reproduce copyrightedmaterial unless it is printed material related to coursework. In the file-sharing context, downloading oruploading substantial parts of a copyrighted work without authority constitutes an infringement.Covenant currently employs bandwidth-shaping technology to limit P2P network traffic.Alternatives to Illegal File Sharing. Covenant Theological Seminary participates in an annualcopyright license agreement for academic institutions that allows duplication for only printed materialsrelated to coursework. This licensing agreement does not apply to digital materials including audiorecordings and video recordings. Educause also maintains a comprehensive list of Legal DownloadingResources (http://www.educause.edu/legalcontent). Members of the Covenant Theological Seminarycommunity are encouraged to take advantage of these legitimate sources of digital content.Summary of Civil and Criminal Penalties for Violation of Federal Copyright Laws. Students whoviolate copyright restrictions will be subject to federal laws and penalties in this area. Copyrightinfringement includes both civil and criminal penalties. In general, anyone found liable for civilcopyright infringement may be ordered to pay either actual damages or “statutory” damages affixed at notless than $750 and not more than $30,000 per work infringed. For “willful” infringement, a court mayaward up to $150,000 per work infringed. A court can, in its discretion, also assess costs and attorney’sfees. (For details, see Title 17, United States Code, Sections 504, 505). Willful copyright infringementcan also result in criminal penalties, including imprisonment of up to five years and fines of up to$250,000 per offense.
