c. The developer shall be responsible for its maintenance until atleast 75% <strong>of</strong> the lots have been sold to individual lot ownersafter which time the association shall be responsible for suchmaintenance and this requirement shall be set forth in the deedcovenants or other legal instrument binding upon the lot ownerand running with the land.d. All proposed deed covenants and legal documents relating tosuch common open space shall be reviewed by the townattorney and the planning board and, if approved, shall berecorded in the <strong>Cumberland</strong> County Registry <strong>of</strong> Deeds andincluded or referred to in the deed <strong>of</strong> each lot..7 Some or all <strong>of</strong> the open space may be dedicated to the <strong>Town</strong> <strong>of</strong><strong>Cumberland</strong>, subject to acceptance by the <strong>Town</strong> Council. Any suchdedication shall be accomplished by deeds or other appropriate legalinstruments acceptable to the town attorney.8 Some or all <strong>of</strong> the open space be conveyed to a non-pr<strong>of</strong>it taxexempt land trust or similar organization for conservation, passiverecreation, or active recreational purposes. Any such conveyanceshall be accomplished by deeds or other appropriate legalinstruments acceptable to the town attorney.406.5 NET RESIDENTIAL DENSITY: The maximum number <strong>of</strong>dwelling units permitted on the tract or parcel <strong>of</strong> land proposed for anytype <strong>of</strong> residential development shall be determined by dividing the netresidential acreage <strong>of</strong> the tract or parcel by the <strong>zoning</strong> districtminimum lot size for the zone in which the project is located. In noevent shall the number <strong>of</strong> residential units exceed the densityrequirement <strong>of</strong> the <strong>zoning</strong> district in which it is located.406.6 CRITERIA TO BE CONSIDERED: In determining whether aproposed residential development shall be constructed as a clusteredresidential development, a traditional residential development, or adispersed residential development, the Planning Board shall considerthe following criteria as required by Title 30-A M.R.S.A. Section 4404and the <strong>Cumberland</strong> Subdivision Ordinance:406.7 STANDARDS FOR REQUIRING CLUSTERED RESIDENTIALDEVELOPMENT: The Planning Board shall require that aresidential development be designed as a clustered residentialdevelopment if the following standards are met:.1 The tract or parcel <strong>of</strong> land to be developed has a public water systemor will be connected to the public water system or the PlanningZoning Ordinance 104 <strong>Town</strong> <strong>of</strong> <strong>Cumberland</strong>
