with the maintenance of common open space and anyrecreational facilities located therein, and this systemshall be described in said deed covenant or by some otherlegal instrument made binding upon the individual unitowner and running with the land..3 The developer shall maintain control of the common openspace and be responsible for its maintenance until 75% ofthe multiplex dwelling units in the subdivision have beensold, at which time, the homeowners' association shall beresponsible for such maintenance, and this obligationshall be described in said deed covenant or by some otherlegal instrument made binding upon the individualdwelling unit owner and running with the land..4 All such proposed deed covenants and other legaldocuments pertaining to common open space shall bereviewed by the town attorney, and, if approved by theplanning board, shall be recorded in the Cumberlandcounty Registry of Deeds, and included or referred to inthe deed to each unit..3 At the option of the Town, some or all of the open space maybe dedicated to the Town of Cumberland, subject to acceptanceby the Town Council..4 Some or all of the open space may be dedicated to a non-profitland trust for conservation, passive recreation purposes oractive recreation purposes..5 Any dedication under subsection .1.8.3 or .1.8.4 above must bemade through appropriate legal instruments, reviewed by theTown Attorney..6 The open space(s) shall be shown on the subdivision plan withappropriate notation on the face thereof to indicate that it shallnot be used for future buildings or structures..7 All legal documents required under this subsection must besubmitted with the final subdivision plan application.Zoning Ordinance 112 Town of Cumberland
