Sec. 605Changes and Amendments605.1 Amendments may be initiated by the Planning Board, the TownCouncil, by any landowner or his authorized agent or by a personhaving a written agreement to purchase the property.605.2 Before public hearing by the Town Council, any proposed amendmentor change, unless initiated by the Planning Board, shall be submitted tothe Planning Board for public hearing and recommendations to theTown Council; public notice of such hearing shall be given bypublication in a newspaper of general circulation within the Town atleast ten days prior to the date thereof.605.3 Amendments to the text or the zoning map shall be consistent with theadopted Comprehensive Plan, and shall be consistent with the purposeof this Ordinance as stated in Sec. 102.605.4 Proposals for change of zone shall include a site plan for the proposeduse drawn in compliance with Sec. 206.2.2, Site Plan Review, andshall also include a location map showing the existing and proposedzone classification and zone boundaries. If a petitioner fails to beginconstruction in a substantial manner in accordance with an approvedplan within one year from the effective date of the rezoning, thePlanning Board shall initiate rezoning to the original zoneclassification by the Town Council. No request for change of zoneshall be considered within one year from the date of Town Councildenial of the same request.605.5 The DEP shall be notified by certified mail of any amendments to Sec.204.5, Resource Protection District, prior to the effective date of suchamendments. A file of return receipts from such mailings shall bemaintained as a permanent record. [Amended, effective 3/23/92]605.6 Attested copies of amendments to any of the Shoreland Zoningprovisions of this Ordinance shall be submitted to the DEP by certifiedmail, return receipt requested. Any such amendment shall not becomeeffective unless approved or deemed approved by the Board ofEnvironmental Protection. Notwithstanding any ordinance or charterprovision to the contrary, upon approval by the Board ofEnvironmental Protection, any such amendment shall become effectiveretroactively upon the date it is received by the Board ofEnvironmental Protection.
