Sec. 430Water Extraction and StorageGround water or spring water may be pumped, extracted and/or bulkstored for wholesale commercial purposes at locations where permittedunder this ordinance, subject to the approval of the Board of Adjustmentand Appeals. Notwithstanding the provisions of Sec. 206.1, the Board ofAdjustment and Appeals shall receive the recommendations of thePlanning Board under Site Plan Review, and shall grant final approval ifit finds that the proposal with any reasonable conditions, will conformwith the additional requirements of Sec. 430.1, below.430.1 Conditions of approval:.1 The quantity of water to be taken from ground water sources will notsubstantially lower the ground water table to the detriment of publicand private wells on adjacent properties, cause salt water intrusion,cause undesirable changes in ground water flow patterns, or causeunacceptable ground subsidence, based on the conditions of adrought with a probability of occurrence of once in ten years..2 The proposed facility will not cause water pollution or otherdiminution of the quality of the aquifer from which the water is to beextracted..3 Safe and healthful conditions will be maintained at all times withinand about the proposed use..4 The proposed use will not cause sedimentation or erosion..5 The proposed facility is not within the defined aquifer recharge areaof a public water supply, unless notice is given to the operatorthereof and the Board has considered any information supplied bythe operator and finds that no adverse affect on a public water supplywill result..6 The operator shall make monthly operating records of the quantity ofwater extracted, stored and removed from the site available to theTown Council or its designee.430.2 The application together with site plan shall include the followingadditional information:.1 Statement of the quantity of ground water to be extracted, expressedas the annual total, the maximum monthly rate by month, and themaximum daily rate;Zoning Ordinance 163 Town of Cumberland
