Sec. 205Lot Regulations205.1 Lots which abut on more than one street shall provide the requiredfront setbacks along each and every street on which that lot abuts, except for alot in existence on August 23, 2005 that meets the followingstandards:[Amended, effective 3/24/03][Amended, effective 12/12/05].a. The lot was created in accordance with all applicable <strong>zoning</strong>requirements in effect at the time <strong>of</strong> its creation;b. The lot is abutted on two or more sides by the street and;c. The lot meets the frontage requirements for its <strong>zoning</strong> districton at least one side <strong>of</strong> the lot. [Amended, effective 3/24/03][Amended, 11/15/05, effective, 12/6/05]Explanation: A lot in existence on (August 23, 2005) and meeting theabove requirements only has to provide the required front setback onone side <strong>of</strong> the lot. Such side must comply with the frontage requiredfor the <strong>zoning</strong> district in which the lot is located. Other sides <strong>of</strong> the lotlocated along the same street may provide the required side setback forthe <strong>zoning</strong> district in which the lot is located.205.2 No structures, whether attached to the principal structure or not, and, whetheropen or enclosed, including porches, carports, balconies, or platforms abovenormal grade level, shall project beyond the setbacks provided in thisOrdinance.205.3 In any district, notwithstanding limitations imposed by other provisions <strong>of</strong>this Ordinance, a single lot <strong>of</strong> record at the effective date <strong>of</strong> adoption <strong>of</strong> thisOrdinance may be built upon subject to the following conditions:.1 Such a lot must be in a separate and distinct ownership from adjacent lotson said date. This provision shall apply even though such lots fail to meetthe minimum requirements for area or width, or both, that are generallyapplicable in the district, provided that yard dimensions <strong>of</strong> the lot shallconform to the requirements for the district in which the lot is located.Variance <strong>of</strong> setback requirements shall be obtained only through action <strong>of</strong>the Board <strong>of</strong> Adjustment and Appeals..2 If two or more lots or combinations <strong>of</strong> lots and portions <strong>of</strong> lots withcontinuous frontage are in single ownership at the time <strong>of</strong> the passage oramendment <strong>of</strong> this Ordinance, and if all or part <strong>of</strong> the lots do not meet therequirements for lot width and area as established by this Ordinance, thelands involved shall be considered to be an individual parcel for thepurpose <strong>of</strong> this Ordinance and no portion <strong>of</strong> said parcel shall be used orsold which does not meet lot width and area requirements established byZoning Ordinance 87 <strong>Town</strong> <strong>of</strong> <strong>Cumberland</strong>
