Sec. 407Conversions407.1 Accessory ApartmentsAny single-family dwelling or an existing accessory structure, which iseither attached or detached, to the dwelling may be altered or expanded toinclude one apartment unit subject to the approval <strong>of</strong> the Board <strong>of</strong>Adjustment and Appeals as a special exception, and in accordance withthe following standards:.1 The unit to be added shall include no more than one bedroom andshall not exceed 40% <strong>of</strong> the total living area <strong>of</strong> the building;[Amended, effective 5/15/89].2 The board may waive the lot size requirements, provided that thePlumbing Inspector indicates adequate capacity and conformity withthe State Plumbing Code; but in no case shall such conversion beallowed on a lot smaller than 20,000 square feet..3 This provision shall not prohibit the conversion <strong>of</strong> a single-familydwelling to a duplex or multiplex dwelling or the conversion <strong>of</strong> aduplex dwelling to a multiplex dwelling, so long as said conversioncomplies with all district and other <strong>zoning</strong> standards, including, butnot limited to the minimum lot size per dwelling unit. [Amended,effective 5/15/89].4 An accessory apartment may be constructed in a detached accessorystructure provided that the lot standards, and the setbackrequirements from the single-family dwelling to the accessorystructure, for the district in which it is located cannot be met for eachstructure. The parcel on which the single-family dwelling and thedetached accessory structure are located cannot be split so that eachstructure is on a separate parcel. [Amended, effective 8/10/98]407.2 Manor HousesAny single family dwelling with no less than 6,000 square feet <strong>of</strong> livingarea may be converted to a multi-family structure with the approval <strong>of</strong> theBoard <strong>of</strong> Adjustment and Appeals as a special exception, subject to thefollowing conditions and any additional conditions imposed by the Board<strong>of</strong> Adjustment and Appeals to assure that said conversion will have noadverse impact on the neighborhood:.1 The conversion <strong>of</strong> a manor house, as defined, into a multi-familystructure shall be deemed a subdivision and subject to final approval<strong>of</strong> the Planning Board in accordance with the SubdivisionOrdinance, after special exception approval has been granted by theBoard <strong>of</strong> Adjustment and Appeals;Zoning Ordinance 113 <strong>Town</strong> <strong>of</strong> <strong>Cumberland</strong>
